Was 17th Century Ireland bound by Statues Passed in England? An Important Contemporary Legal ManuscriptManuscript: Bolton (Sir Richard) A large folio volume bound in white vellum, containing in a neat mid-17th-century script the text of two treatises on the independence of the Irish parliament from that of England:(1)Pp 1-43: "A Disquisition touching that great Question. Whether An Act of Parliament made in England shall Bind the Kingdome and People of Ireland without theire Allowance and Acceptance of such Act in ye Kingdome of Ireland." Marked at end: "Examinat. Domvile, July, 1660."(2)Pp 51-114: "A Declaration setting forth how and by what meanes the Lawes and Statutes of England from time to time came to be of force in Ireland." Marked at end: Richard Bolton, Cancellarius Hiber[niae]."The "Disquisition" argues the ancient and modern independence of Ireland from the English parliament, with many quotations in Latin or otherwise from ancient authors and statutes. The "Declaration" follows a similar argument, but also stresses that both parliaments are subject to the King. This subject was hotly debated in mid-17th-century Ireland, and gave rise to three important treatises, of which these are the first two and the third is the better known The Case of Ireland's being Bound by Acts of Parliament in England, Stated, by William Molyneux, published in 1698.The "Disquisition" was written in July 1660 by William Domvile, Attorney General for Ireland, who presented it to the Lord Lieutenant, the Duke of Ormond. Molyneux, who was Domvile's son-in-law, made extensive use of it in his Case of Ireland. The full text, however, has only been published recently (by Patrick Kelly, Analecta Hibernica no. 40, 2007, pp 19-70).The "Declaration" was written earlier, in 1644, during the negotiations between the government and the commissioners of the Catholic Confederation. Its authorship has long been disputed. Molyneux believed it to be the work of Sir Richard Bolton, Lord Chancellor of Ireland, but Walter Harris, who published the text in 1750 in the second part of his work Hibernica, attributed it to the Catholic lawyer Patrick Darcy. The matter has only been resolved in recent times with the publication of an article by Dr Patrick Kelly in Irish Historical Studies, vol. 35 (2006), pp 1-16. The fact that our M/ss, which was evidently written by or for Domvile, cites Bolton as the author, should put the matter finally beyond doubt. As a m/ss., w.a.f. Extremely Rare. (1)

The Royal North Down Rifles Military Theatricals. A 19th century Album compiled probably by Capt. (later Lt.-Col.) G. Rowan Hamilton of the Royal North Down Rifles, containing about 45 programmes for amateur dramatic and musical performances, 1860s-1890s, mostly locally printed, featuring members of British garrison forces and their families and friends; also news cuttings about military affairs, many featuring the North Down Rifles, including some reports of disturbances and a manuscript parade record. In a folio album, much worn. With the original manuscript of a talk by the historian and bibliophile P.S. O'Hegarty, 17 pp, headed 'Some Ephemeral Local Printing', discussing the album and its contents. The programmes include items printed by J. Wier, 'Observer' office, Ballymena; Dollard, Dublin; Bray & South Dublin Herald, Wicklow; 'Down Recorder', Downpatrick; Wm. Strain & Sons, Belfast; Wm. Henry, 'Newtownards Chronicle'; Recorder Printing Works, Bray; W. & G. Baird; Moat Bros., Rosemary Street, Belfast; M'Caw, Stevenson & Orr, Belfast; Morgan, Mountmellick; and others. Many of the cast-lists include Capt.Rowan Hamilton, regimental colleagues and members of his family. There are also several programmes from the Theatre Royal, Fort Manoel [Malta], and a poster for Lt. Col. Hamilton's retirement parade in Bristol.O'Hegarty's manuscript points out that garrison forces generally had little to do when there was no war on, and theatricals provided a harmless diversion for their officers. The programmes are laid down, tipped in or laid in. They are not in chronological order. Condition is only fair, many are creased, torn or frayed, sometimes with loss, but most of them are certainly rare if not unique. As a collection, w.a.f. (1)

The family seat was Fort Anne, Tulla, Co. Clare. They trace his descent through various lines, paternal and maternal. 'Bosh'[McCartan (Patrick)] Manifesto to the Whole Students of Ireland. Issued by the Dublin Students' Dungannon Club, 22 North Great George's Street, Dublin. An Cló-Chumann, D. 1906. Yellow printed wrappers, 8 pp, vertical fold marks. Seoirse Mac Gabhacháin Ó Dubhthaigh's copy [George Gavan Duffy] with his signature and his pungent marginal comments (e.g. 'Bosh', p. 6). Gavan Duffy came of a distinguished legal family. He was part of Roger Casement's legal team in London, losing much of his practice there as a result. He became a Sinn Fein MP and a Treaty negotiator, and was the last of the Irish delegates to sign. He was Minister for Foreign Affairs in the second Dail, but resigned from the Government when it decided to suppress the Supreme Court. He became a judge, and was later President of the High Court.A rare item, not found in COPAC. Ascribed to Patrick McCartan by the NLI. (1)

Volunteer Officers Statement of 18 June 1917. A contemporary photographic copy of a manuscript statement signed by Volunteer commandants just released from English jails, headed by Eamon de Valera, appealing to U.S. President Wilson to support the rights of small nations including Ireland. Framed and glazed, 14" x 18".The statement was signed by Volunteer officers on the day of their arrival in Dublin, before they dispersed to their home places. Signatories include Eoin MacNeill, Roibeard Ó Breandáin, Tomás Ashe, Aoibhistin de Staic and more than 20 others (but not Michael Collins, released some months earlier, who was not then a Volunteer commandant).Apparently the earliest document of historical significance signed by Eamon de Valera. It marks the first regrouping of the Volunteers after the Rising, and effectively recognises De Valera as their leader. The original was brought to the United States by Patrick McCartan (IRB member), and was accepted from him at the Capitol by Joseph Tumulty, private secretary to President Wilson. Presumably it is now in the Library of Congress. A very rare photograph, perhaps the only surviving copy. The text is in Macardle, The Irish Republic, and it is mentioned in Coogan's Michael Collins, but we have not found the document reproduced elsewhere. It is not in Ferriter's recent De Valera biography. (1)Provenance: Inscribed lower right 'to a lover of Irish history' by Frank Robbins, a Citizen Army member.

Rare Portrait of Jonathan SwiftNathaniel Bermingham (b. Ireland c. 1720 F / 1736-74) Portrait of Jonathan Swift, c. 1774, head and shoulders, in white cut paper against black, wearing a curly grey wig, oval, 11 1/2" high x 8 1/2" wide (29cms x 22cms). the frame is carved sand gilt. With the Swift family crest and leaf sprays. This very rare portrait by Bermingham displays in great detail the art of cut paper. Bermingham was noted for his small portraits and coats of arms, cut in paper or vellum. He headed to London c. 1774 and exhibited his works at the Society of Artists. Including a portrait in cut paper of The Duke of Gloucester, his address was at "Mr. Kelly's, The Cane Shop near Temple Bar." In 2009 The Arms of John Boyle, 5th Earl of Cork and Orrery (1707 - 1762) was offered by Christie's as lot 53. Also in cut paper. It was part of the Glin Castle Sale, 7th May 2009. It measured 38cms x 31cms and it sold for £20,000. The Victoria and Albert Museum have a cut paper portrait of Britannia mourning The Prince of Wales.Provenance: Rushbrooke Hall, Bury St. Edmunds. Originally the home of The Jermyn Family, with the Rothschild Family taking over the house in 1938. In 2015 there was an auction of items from the kitchens of Rushbrooke Hall which included this unidentified "Picture of a Nobleman". Swift refers several times to cut paperwork in his "Miscellanies". He quotes in "Dan Jackson's Picture Cut in Paper," "Clarissa drew her scissors from the case, to draw the lines of poor Dan Jackson's Face. One sloping line cut forehead, nose and chin, a nick produced a mouth and made him grin."

Yeats to Miss Garnett, Donnington Place, Framlingham, Sussex, postmarked Dundrum, Oct 17 [19]05. 'We have posted 50 prints of your block to your brother today - How many more prints do you want us to do?' Endorsed at head, 'Think the estimate was 500 for 20/- but have no business papers with me. If this is correct please do the remainder making up to the 500. A.G. 24.10.05.'With a copy of Cuala's 'Garnett' bookplate, featuring a dragon and a dragonfly, presumably the item referred to.(b) ALS from Evelyn Gleeson to Miss Garnett, Aug. 5 1924, 2 pp (single sheet), on attractive headed Dun Emer Guild paper. 'I was so very pleased to have a letter from you. I have not been much in London of late years, but I often wondered how you were .. Yes, I am still making rugs and carpets - I do not do so many of the designs now as my niece has grown up, a very clever designer .. If you like, we can send you some coloured sketches to show to your friend. I was so glad to hear that the rugs you have of mine have worn so well. There is a great deal of weaving done over here now and some of the pieces are beautiful ..' With a good signature.Letters from Evelyn Gleeson are rare. She was the originator of the entire Dun Emer enterprise, inviting Elizabeth and Susan (Lily) Yeats, then living in London with their father, to return to Dublin in 1902 and start a craftwork enterprise with her. Disagreements developed, and in 1903 the Yeats sisters set up on their own as printers and embroiderers under the Cuala name, leaving Miss Gleeson with the Dun Emer title and the weaving business, in which she continued until her death in 1944. Miss Garnett may be a relation of the critic Edward Garnett. (3)

Inscribed to 'My Friend Maud Gonne'Yeats (W.B.) The Wanderings of Oisin. Dramatic Sketches, Ballads & Lyrics. Fisher Unwin, L. 1892, green paper boards, parchment spine, t.e.g., uncut, some pages unopened. The second issue, one of fewer than 100 copies bound from remaining sheets of the first (Kegan Paul) issue, with cancel title page and added f.p. illus. by Edwin Ellis. Wade 3. See letter from Yeats to John O'Leary, late February 1892, where he says about 80 or 90 copies were so bound (Kelly ed. Coll. Letters v. 1 p. 287). Spine and boards a little soiled, catalogue number in ink at base of spine. This Copy Superbly Inscribed in Yeats' hand on front pastedown, 'To / My friend / Maud Gonne / W.B. Yeats / May 19 1892'; and with a correction probably in Yeats' hand to the 'By the same Author' list on reverse of t.p.A wonderful memento of a loving friendship, which dominated Yeats' early life and inspired much of his greatest poetry.Yeats first met Maud Gonne on 30 January 1889, a few weeks after publication of the first issue of this book, when she arrived at his father's home in Bedford Park (London) with an introduction from a mutual friend, the Fenian John O'Leary.Thereupon 'the troubling of my life began'. By 1892 she had already declined his first proposal of marriage, and they agreed to remain friends, and to co-operate on various projects both national and mystical. It was a friendship which unsettled Yeats' life for more than 20 years, but gave him a magnificent harvest in his poetry. Surviving items inscribed by Yeats to Maud Gonne are now of the greatest rarity. Gonne's unsettled life around this time was not conducive to preservation of mementos; during the Civil War her Dublin home was several times searched and its contents trashed by Free State forces. The book itself is very rare in this issue. We have not previously seen a copy in more than 30 years in business. COPAC records only two copies, at the British Library and Cambridge. There is also a copy at NLI.A superb, rare and most desirable item. (1)
