The idea, and the branding, are his. The works are produced by assistants according to strict instructions and controls. Gerhard Richter had earlier on made several colour-card paintings, a comparable idea that he did not extend into a prolonged series (unlike Hirst, he disclaims all associations with conceptualism), and they did not become as instantly recognisable as Hirst's Spots, with their toy-like quality and cheerful colours.
