In my time as an auctioneer one occasionally comes something that you are at a loss of how to catalogue, this wonderful creation is one of those times, so I think the best way is to tell a story with a little bit of poetic license. In 1929, engineer, John Shaw of Scarcroft in Leeds, began designing and building his own motorcycle using an ABC motor cycle frame and an Austin Seven motor car engine. One presumes that he either had an old ABC with a broken engine or an Austin with a damaged chassis/body. The ABC was produced by the Sopwith Aircraft Company and designed by Granville Bradshaw, who had developed a 398cc overhead valve flat twin engine during the Great War and placed it in a duplex loop frame with sprung front and rear forks. It was one of the most advanced designs of its time but did not sell well and the company folded in the mid 1920?s. The Austin, being of small size, fitted quite well within the frame and he then designed the shaft drive to power it. There is a photograph on file of the shaft drive being on the right-hand side of the machine, maybe a mark one version, as he soon decided on across the frame with flexible couplings to the rear wheel via a cardan shaft. By late 1929/early 1930 he had decided on the finished article which used the c.1927 Austin Seven and gearbox, mounted at an angle, with twin radiators, (similar to a Scott). With three forward gears and reverse, it used either a hand or lever operated clutch, coupled brakes by hand or foot, electric or foot start, riding on AJS 26? wheels, the rear being detachable. During 1930 and 1931 Shaw then undertook some 8,000 miles of touring on all kinds of roads and tracks in Britain including Park Rash (Kettlewell), Keigthley Gate (Ilkley) and Middle Tongue (Cumbria) which provided information on the performance of the motor bike. By 1931 he was satisfied that his machine was running perfectly and he successfully patented the coupling mechanism with the shaft drive (patent number 393,947, submitted on the 10th December 1931 and granted on the 12th June 1933). In the mid 1930?s he toured the continent with his wife as pillion rider for two or three weeks at a time on several occasions. Interestingly George Bough introduced the Brough Superior Austin Four for the 1931 Olympia Motorcycle Show. It was listed in the 1932 Brough Superior catalogue as the 'Straight Four' but it was commonly known as the Brough Superior Austin Four, or BS4, or '3-wheeled Brough'. The machine is powered by a modified Austin 7 engine and gearbox unit, from which a driveshaft emerges on the centre-line of the motor. Rather than design a new gearbox, George Brough kept the central driveshaft, and use a pair of close-couple rear wheels driven by a central final drive box. This 3-wheeled design was legally considered a motorcycle as the wheel centres were within 24". One wonders if Brough had seen Shaw?s machine? During 1931 The Motor Cycle magazine had four articles on the Shaw Special, August 31st under the title ?The Nameless Wonder?, September 3rd, December 10th when Shaw, under the pseudonym Austin Primus, describes its particulars and the 24th December under ?An Enthusiast?s Austin-engined Machine?. At some point the engine was bored out by 40 thousanths, possibly to gain more power. John Shaw was an engineer of some repute having also designed and built an aluminium bodied car with the A55 engine and latterly even designed his own house in Scarcroft. He was recruited as works manager to the purpose built factory at Crewe to produce the Merlin aero-engines which powered the Spitfire and Avro planes during WW2. Shaw passed away in 1967 and his wife loaned the machine to the Nostell Priory Museum, where it remained until Sotheby?s sold the Harry Fenby collection that had made up the bulk of the museum in 1980. It was returned to Mrs Shaw who gave it to her nephew in law, our vendor. Unfortunately, the museum had lost its original number plates and substituted others and therefore our vendor applied to the Local Vehicle Licensing Office in Hull in 1983 for a V5 with the correct registration mark and this was provided. As they could not locate a frame number, they issued it a new one and asked for it to be stamped, and this was to be undertaken during restoration. However during the stripping the original number appeared on the headstock when the frame was restored. Unused for many years, he decided in 2010 to have it restored by Chris Woodcock of Norton. The engine was stripped and rebuilt, (when the rebore was discovered) , gearbox and clutch overhauled, a replacement Zenith carburettor was fitted as the original Amal had metal fatigue (included with the sale), frame and metalware was powder coated, radiators overhauled, nickel plated and rechromed where required, speedo, magneto and dynamo reconditioned and the seat recovered (original included). Since the restoration it has been regularly started up but not ridden and he has now decided to part with this wonderful creation, when viewed the engine fired on the first pull of the starter and sounded very quiet and smooth. Sold with the V5C, copy V5, copy of the patent, the original magazine articles, various period photographs, a CD of the restoration work and other paperwork. Conditions of Sale

 

  1. All lots will be offered for sale subject to these conditions of sale for veteran, vintage and classic vehicles, motorcycles and automobilia.

     

  2. Spicers Auctioneers act as agents for the vendor of each lot and shall not be party to or liable in any manner whatsoever on any contract of sale between the seller and the buyer.

     

  3. The Buyer.

  1. The highest bidder acknowledged as such by the auctioneer will be the buyer.  If any dispute arises, the auctioneer shall have absolute discretion to settle the matter.  The auctioneer shall rule the bidding and no bid shall be retracted.  The auctioneer reserves the right to refuse any bid.  The bidder at the sale who is successful in purchasing any lot or lots is entirely responsible for paying for such lot or lots in accordance with our terms of business.  Purchases made on behalf of a third party are entirely the responsibility of the bidder at the sale.  The auctioneer reserves the right to bid on behalf of the vendors for any lot and to withdraw, consolidate or divide any lot or lots.

     

  2. The buyer of any lot shall be solely responsible for conforming with the requirements of the Road Traffic Acts, the Construction and Use of Motor Vehicle Regulations and all relevant orders, rules and legislation made in connection therewith.

     

  3. The buyer of any lot shall be solely responsible for the obtaining of any export licence that may be required in connection with any lot purchased. (See below).

     

    Export Licences

  1. Buyers are reminded that an export licence is required for any vehicle purchased for more than Ā£15,000 and manufactured or produced 50 years prior to the date of export.  Certain other items including, inter alia, all manuscripts and documents 50 or more years old and photographic material 60 or more years old and valued at Ā£400 or more require export licences.

  2. It should be noted that export licences usually take a minimum of four weeks to obtain and buyers are reminded that their purchases must be stored away from the auction side, at their cost, pending export.

  3. Buyers are reminded that it is a serious offence to breach or attempt the regulations concerning export licences.

 

  1. Buyers are reminded that their purchases are held at their risk from the fall of the hammer and Spicers Auctioneers will not accept any liability for loss or damage to any lot.

 

 

 

  1. Registration.  To assist the progress of the sale, all prospective buyers must register their name and address at reception and collect a numbered bidding card before the sale commences.  This card may be used to indicate your bids to the auctioneer during the sale.  Two forms of identification need to be supplied to register, at least one with a name, address, signature and preferably photograph, for example a new style driving licence.  For prospective buyers who will not be at the sale, either because they are leaving absentee bids or are having a telephone bid, and who are interested in a vehicle or motorbike, a Ā£1,000 deposit will need to be paid.  This will be refunded if the bid is not successful.  If the bid is successful, this sum will be used towards the final bill.

 

  1. Buyerā€™s Premium.  A buyerā€™s premium of 15% including VAT is payable on the final bid price of each car or motorbike, a buyerā€™s premium of 20% including VAT is payable on the final bid price of each lot in the Automobilia and spares sections.

     

  2. Value Added Tax.  Lots on which Value Added Tax may be payable by the buyer on the ā€œhammer priceā€ are indicated in the catalogue by a symbol beside the lot number.  The buyer shall pay any VAT which may be due on any amounts owed by the buyer under these Terms of Business at the rates prevailing on the day of the auction.

     

  3. Auctioneers Margin Scheme.  The Auctioneers Margin Scheme allows auctioneers to sell items without VAT on the hammer price.  Under the margin scheme an amount equivalent to VAT at the current rate is added to the buyerā€™s premium.  This amount cannot be refunded.  The VAT element will not be shown separately on the buyers invoice.

     

  4. Payment.  The purchase price must be paid by the buyer to Spicers Auctioneers no later than 12 noon on the Monday following the sale.  Our methods of payment are with cash or card.  Cash for amounts over Ā£3,000 will not be accepted.  All purchases must be paid in full before any lot is removed from the premises.  Any buyers unknown to the auctioneer must establish a bank reference with the Accounts department prior the sale.  Anyone who, for whatever reason, is unable to pay for their goods on the day of the sale, must inform the Accounts department as to the date and method that payment will be made.  Accounts not paid within fourteen days will automatically be subject to an interest charge of 5% above base rate from the day of sale.

  1. On the fall of the hammer, a contract of sale is completed between the seller and the buyer.  Spicers Auctioneers is not a party to the contract of sale and shall not be liable for any breach thereof by the buyer or the seller.

If successful in buying a lot, please ensure that your number can be seen by the auctioneer and that it is your number that is called out.  Should there be any doubts as to price or buyer, please draw the auctioneerā€™s attention to it immediately.  Please contact the accounts desk with details of how you will pay.

  3. The ownership of the lot(s) purchased will not pass to the buyer until the buyer has paid the auctioneers in full the total amount due and the auctioneers have applied such payment to the lot.

Transfer of Risk.  Each lot shall be the purchaserā€™s sole risk from the fall of the hammer and shall be sold with all faults and imperfections, the auctioneer not being responsible for the correct description, genuineness or authenticity of any lot and making no warranty whatsoever.  The purchaser is deemed to have inspected the lots and satisfied himself as to their condition.

 

  1. Commission Bids.  If instructed, the auctioneers will execute bids and advise prospective purchasers.  This service is free.  Lots will always be purchased as cheaply as is allowed by such other bids and reserves that are on the auctioneerā€™s books.  In the event of identical bids, the earliest will take precedence.  There must always be a maximum limit indicated, i.e. the amount to which you would bid if you were attending he auction yourself.  ā€œBuyā€ or unlimited bids will not be accepted.  Commission bids placed by telephone are accepted at the clientā€™s risk.  We do accept commission bids by facsimile and email, providing they are accompanied by full name and address details.  We urge our clients to place such commission bids within one hour of the close of the view day.

     

  2. Telephone Bids.  Requests for telephone bidding must be registered with the accounts department within one hour of the close of the view day.  It may not be possible to accept requests on sale days.  Written confirmation of such bids from persons unknown to the auctioneers must be received before the commencement of the sale.  Whilst every effort will be made to execute telephone bidding, the auctioneers cannot be held responsible for any default or neglect in connection with this service.  All such arrangements therefore are made entirely at the prospective buyerā€™s risk.

     

  3. Collection of Goods.  All vehicles must be collected by 2.00pm on the Sunday following the sale. Automobilia not collected by this time will be brought back to Driffield at a cost of Ā£5 plus V.A.T. per lot.  Cars not collected by 2.00pm on the Sunday following the sale will be removed to a secure local compound at a cost of Ā£70.00 plus V.A.T. per vehicle.  Motorcycles not collected by 2.00pm on the Sunday following the sale will be removed to our compound at a cost of Ā£40.00 plus V.A.T. per motorcycle.  Storage charges will then be levied at Ā£10.00 per vehicle per day or part thereof.  Lots will only be released to the buyer or their authorised representative upon presentation of release notes issued by Spicers Auctioneers and settlement of any removal, handling and storage charges due.  Purchasers are reminded that each lot shall be the purchaserā€™s sole risk from the fall of the hammer.  Buyers should be aware that no lots will remain at the auction site after 2.00pm on the Sunday following the sale.

     

  4. Third Party Liability.  Every person on the auctioneerā€™s premises before, during or after a sale, shall be deemed to be there at their own risk and shall have no claim against the auctioneer or owner of the auction premises in respect of any injury they may sustain or any accident which may occur.

Conditions of Sale

 

  1. All lots will be offered for sale subject to these conditions of sale for veteran, vintage and classic vehicles, motorcycles and automobilia.

     

  2. Spicers Auctioneers act as agents for the vendor of each lot and shall not be party to or liable in any manner whatsoever on any contract of sale between the seller and the buyer.

     

  3. The Buyer.

  1. The highest bidder acknowledged as such by the auctioneer will be the buyer.  If any dispute arises, the auctioneer shall have absolute discretion to settle the matter.  The auctioneer shall rule the bidding and no bid shall be retracted.  The auctioneer reserves the right to refuse any bid.  The bidder at the sale who is successful in purchasing any lot or lots is entirely responsible for paying for such lot or lots in accordance with our terms of business.  Purchases made on behalf of a third party are entirely the responsibility of the bidder at the sale.  The auctioneer reserves the right to bid on behalf of the vendors for any lot and to withdraw, consolidate or divide any lot or lots.

     

  2. The buyer of any lot shall be solely responsible for conforming with the requirements of the Road Traffic Acts, the Construction and Use of Motor Vehicle Regulations and all relevant orders, rules and legislation made in connection therewith.

     

  3. The buyer of any lot shall be solely responsible for the obtaining of any export licence that may be required in connection with any lot purchased. (See below).

     

    Export Licences

  1. Buyers are reminded that an export licence is required for any vehicle purchased for more than Ā£15,000 and manufactured or produced 50 years prior to the date of export.  Certain other items including, inter alia, all manuscripts and documents 50 or more years old and photographic material 60 or more years old and valued at Ā£400 or more require export licences.

  2. It should be noted that export licences usually take a minimum of four weeks to obtain and buyers are reminded that their purchases must be stored away from the auction side, at their cost, pending export.

  3. Buyers are reminded that it is a serious offence to breach or attempt the regulations concerning export licences.

 

  1. Buyers are reminded that their purchases are held at their risk from the fall of the hammer and Spicers Auctioneers will not accept any liability for loss or damage to any lot.

 

 

 

  1. Registration.  To assist the progress of the sale, all prospective buyers must register their name and address at reception and collect a numbered bidding card before the sale commences.  This card may be used to indicate your bids to the auctioneer during the sale.  Two forms of identification need to be supplied to register, at least one with a name, address, signature and preferably photograph, for example a new style driving licence.  For prospective buyers who will not be at the sale, either because they are leaving absentee bids or are having a telephone bid, and who are interested in a vehicle or motorbike, a Ā£1,000 deposit will need to be paid.  This will be refunded if the bid is not successful.  If the bid is successful, this sum will be used towards the final bill.

 

  1. Buyerā€™s Premium.  A buyerā€™s premium of 15% including VAT is payable on the final bid price of each car or motorbike, a buyerā€™s premium of 20% including VAT is payable on the final bid price of each lot in the Automobilia and spares sections.

     

  2. Value Added Tax.  Lots on which Value Added Tax may be payable by the buyer on the ā€œhammer priceā€ are indicated in the catalogue by a symbol beside the lot number.  The buyer shall pay any VAT which may be due on any amounts owed by the buyer under these Terms of Business at the rates prevailing on the day of the auction.

     

  3. Auctioneers Margin Scheme.  The Auctioneers Margin Scheme allows auctioneers to sell items without VAT on the hammer price.  Under the margin scheme an amount equivalent to VAT at the current rate is added to the buyerā€™s premium.  This amount cannot be refunded.  The VAT element will not be shown separately on the buyers invoice.

     

  4. Payment.  The purchase price must be paid by the buyer to Spicers Auctioneers no later than 12 noon on the Monday following the sale.  Our methods of payment are with cash or card.  Cash for amounts over Ā£3,000 will not be accepted.  All purchases must be paid in full before any lot is removed from the premises.  Any buyers unknown to the auctioneer must establish a bank reference with the Accounts department prior the sale.  Anyone who, for whatever reason, is unable to pay for their goods on the day of the sale, must inform the Accounts department as to the date and method that payment will be made.  Accounts not paid within fourteen days will automatically be subject to an interest charge of 5% above base rate from the day of sale.
