Terms & Conditions for Buyers


Cataloguing
Sarjeant Group LTD (hereinafter called SG GROUP LTD) takes care to ensure that any statement as to authorship, attribution, origin, date, age, and provenance is accurate. Such statements should be read as if prefixed by the phrase: “In the opinion of SG GROUP LTD this lot is…” SG GROUP LTD reserve the right in forming their opinion to rely upon any authority reasonably considered by them to be reliable. 

For specific information regarding the following topics, please see the notes in bold at the beginning of each of the following sections within the catalogue: Jewellery and Objects of Vertu (notes on stones and metals), Silver (Hallmarking Act), Books (collation), Drawings and Paintings (explanation of terms), etc. 

Please note that all mechanical items (any item with moving parts),  e.g. clockwork items, clocks and watches, barometers, musical items, firearms, electrical items, etc, may need attention, and are sold as seen. 

Condition Reports
As this is a sale of antique objects, buyers should anticipate signs of manufacture, age and usage. SG GROUP LTD endeavour to accurately assess the condition of all lots and to provide the buyer with realistic information. As with all objects, such opinions are subjective. Any statement within the printed catalogue regarding damage to specific lots does not preclude the possibility of the existence of other faults not mentioned. Condition reports are produced at the time of cataloguing, to ensure that all enquiries receive the same response. These are intended as an aid to buying, and it is strongly recommended that all buyers request a condition report for every lot they wish to bid on, especially if they are not in attendance. Any statements, conditions or descriptions in the catalogue or elsewhere are subject to any qualifying or modifying statement made by the auctioneer from the rostrum prior to any bid being accepted for any lot. Absentee bidders will be informed of changes wherever possible.

Bidding
SG GROUP LTD are pleased to execute absentee commission or telephone bids, as cheaply as reserves and other bids allow, at the request of the bidder. Such bids may be placed in writing, by e-mail, telephone or fax, prior to the morning of sale.

 

  

 

SG GROUP LTD endeavour to execute bids received on sale day, but telephone and commission bids received less than 30 minutes prior to commencement of the sale are accepted at the discretion of SG GROUP LTD staff, as are bids received during the sale. For this reason, bidders are strongly advised to place bids by the end of the day prior to sale. The placing of a bid indicates that the buyer has read and fully understood these terms and conditions, and is satisfied as to the condition of the lot(s) concerned.

 

  

 

All questions should be resolved before bidding. As a legal contract, bids may not be retracted after the lot is sold. SG GROUP LTD retains the right to refuse bids, and to withdraw any lots from the sale at the request of the vendor or at SG GROUP LTD’s own discretion whenever necessary and without prior notice. SG GROUP LTD cannot accept responsibility for any expense incurred by any intending purchaser of any lot so withdrawn. Buyers in any doubt should contact the auctioneers before the sale.

 

  

 

Bidding via The-Saleroom.com

 

In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Sarjeant Group Ltd you:

 

(i) authorise Sarjeant Group Ltd, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the sale via the-saleroom.com, and

 

(ii) confirm that you are authorised to provide these credit card details to Sarjeant Group Ltd through www.the-saleroom.com and agree that Sarjeant Group Ltd are entitled to ship the goods to the cardholder name and cardholder address provided in fulfilment of the sale.

 

 

 

Telephone Bids
These are undertaken by SG GROUP LTD at the risk of the bidder, subject to a line being pre-booked and the bidder being obtainable on the given number at the time of sale. SG GROUP LTD takes no responsibility for missed or engaged calls or incorrectly-dictated telephone numbers. Telephone bidders are advised to consider leaving a “back-up bid” (which does not appears on the auctioneers book, but stays with the staff member executing the telephone bid) so that staff can still bid if the line is unobtainable.

Reserves
All lots are put up for sale subject to any reserve price imposed by the vendor, which shall be no higher than the lower estimate. 

Title & Risk
The property in a lot shall pass to the purchaser only on payment in full of the purchase price, but every lot is at the sole risk of the purchaser from the fall of the hammer.

Disputes
The highest bidder shall be the buyer. If any dispute arises, SG GROUP LTD shall have the discretion to settle it and resell any disputed lot.

 

 

Refunds
Buyers seeking compensation will only be refunded upon fulfilment of the following conditions:
(a) Notification in writing within seven days that the lot:
  (i) is a deliberate forgery, copy or reproduction, or
  (ii) has been grossly misrepresented in the catalogue description by SG GROUP LTD, or
  (iii) the condition of the lot has been grossly misrepresented in the condition report prepared by SG GROUP LTD.
(b) Proof to that effect, in writing, from an independent authority within fourteen days, the burden of proof resting solely upon the purchaser. The vendor, for whom SG GROUP LTD act as agent only, and the purchaser agree to be bound by SG GROUP LTD’s decision in this case. 
SG GROUP LTD will not refund a sale if a condition report was not sought by the buyer.
 
Payment
Purchases must be paid for prior to removal from the saleroom, without exception. Payment may be made by cash, cheque, debit card (free), credit card & business debit cards (2.50% surcharge). For international buyers, direct bank transfers are possible (please contact the office for details).
 
Postage & Packing
We offer a packing service for most items. We endeavour to pack items safely and appropriately and dispatch them by a choice of couriers as preferred by the buyer. This service is provided at the sole risk of the buyer, and they should ensure adequate insurance and provide accurate instructions. SG GROUP LTD will pass on the cost of postage plus sufficient funds to cover time and materials as appropriate to each case. Absentee buyers should obtain estimates before bidding and exact quotes once the items are purchased and packed. SG GROUP LTD waives responsibility for “accidents in transit” where adequate packing has been provided.
 
Removal of Items
If, after fourteen days items of furniture have not been paid for and removed by the purchaser they may be subject to additional storage charges at SG GROUP LTD’s discretion. 
 
Removal of Items (Not paid for)
If, after thirty days, items are uncollected and remain unpaid for, SG GROUP LTD reserve the right to re-sell such items, by auction or by private treaty and without further notice, with any loss arising from such re-sale, together with the charges and expenses relating to both sales, to be borne by the original (defaulting) buyer. Any money deposited in part-payment shall be held by SG GROUP LTD on account of any liability of the defaulter to them.
