1. All statements contained in the catalogue as to any Lot are made without responsibility on the part of the vendors or the auctioneers.

2. All statements contained in the catalogue as to the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any Lot are statements of opinion and are not to be taken as, or implying, statements or representations of fact.

3. Intending purchasers must satisfy themselves by inspection or otherwise as to all matters as to the physical description of any Lot whether any Lot or Lots have been withdrawn or if the sale has been cancelled.

4. Neither the vendor of any Lot nor the auctioneers make or give, nor has any person in the employment of the auctioneers any authority to make or give, any representation or warranty in relation to any lot.

5. Neals offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale.
In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Neals you:
1. authorise Neals, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
2. confirm that you are authorised to provide these credit card details to Neals through www.the-saleroom.com and agree that Neals are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
Please note that any lots purchased via the-saleroom.com live auction service will be subject to a 15% supplement plus VAT at the rate imposed on the hammer price.


CONDITIONS OF SALE
1. The auctioneers act as agents for the vendor only. Each Lot as set out in the catalogue, or as divided or joined with any Lot or Lots at the sale at the sole discretion of the auctioneers, is sold with all faults, imperfections and errors of description, and neither the vendor nor the auctioneer are responsible for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any Lot. All statements in the catalogue as to any such matters are statements of opinion, and are not to be taken as, or implying, statements or representations of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any Lot including but not restricted as to whether the Lot is damaged or has been repaired or restored. Neither the vendor nor the auctioneers make or give, nor has any person in the employment of the auctioneers any authority to make or give, any representation or warranty, and in any event neither the vendor nor the auctioneers are responsible for any representation or warranty or for any statement in the catalogues. Any claim under any Statute must be received in writing by the auctioneers within ten days of the day of the sale.

The auctioneers as agents for the vendor have the right to withdraw any Lot or Lots and to cancel the sale without giving any reason of notice. All conditions, notices, descriptions, statements and other matters in the catalogue and elsewhere concerning any Lot are subject to any statement modifying or affecting the same made by the auctioneer from the rostrum prior to any bid being accepted for the Lot.

2. Subject to the reserve price, if any, up to which Figure the auctioneers reserves the right of bidding, the highest bidder shall be the purchaser, and if any dispute arise between two or more bidders the auctioneer shall adjudicate and his decision shall be final and binding on both parties. No person to advance a less sum than shall be named by the auctioneer, nor to retract his or her bidding. No Lot to be removed until paid for.

3. The purchasers to give in their full names and permanent address and pay for each at the fall of the hammer (if required), in default of which the Lot to be put up again and resold. The auctioneer reserves the right of withdrawing, consolidating, dividing or altering the order of any Lots.

4. Notwithstanding any other terms of these conditions, if within fourteen days after the sale the auctioneers have received from the buyer of any Lot notice in writing that in his view the Lot is a deliberate forgery and within twenty one days after such notification the buyer returns the same to the auctioneers in the same condition as at the time of the sale and by producing evidence, the burden of proof to be upon the buyer, satisfies the auctioneers that considered in the light of the entry in the catalogue the Lot is a deliberate forgery, then the sale of the Lot will be rescinded and the purchase price of the same refunded. In the event of a dispute then the matter shall be settled by arbitration, the arbitrator to be nominated by the President of the Royal Institution of Chartered Surveyors. Both the buyer and the vendor agree to be bound by the decision.

5. The auctioneers disclaim responsibility for default by either the buyer or the vendor because they act as agent for the vendor only and therefore do not pay out to the vendor until payment is received from the buyer. Instructions given by telephone are accepted at the Senders risk and must be confirmed in writing forthwith.

6. In the event of a sale by private treaty both the vendor and the buyer agree to be bound by the Conditions of Sale.

7. Every bidder shall be deemed to act as Principal unless there is in force a written acknowledgement by the auctioneers that he acts as agent on behalf of the named Principal.

8. All Lots to be paid for on or before the close of sale, and shall remain at the risk of the respective purchasers from the fall of the hammer until their removal; the same to be taken with all faults and errors of description. All Lots must be cleared by 12noon on the day following the sale. No Lots to be removed during the progress of sale.

9. It is expressly stipulated that all Lots are sold for Cash Before Delivery (unless a previous arrangement has been made with the auctioneers); and should the delivery of a Lot or Lots be obtained by the tender of a cheque, which shall be unprovided for, the purchaser so acting will be deemed guilty of obtaining goods under false pretences and be legally dealt with accordingly. The contract of a sale shall be deemed to be with the auctioneers and all payments to be made to them.

Cheques from persons unknown to the auctioneer cannot be accepted.

10. Upon failure of complying with any of the above Conditions the Lots uncleared shall be resold by public or private sale and the deficiency (if any) together with all expenses attending such resale shall be made good by the defaulter at this sale.

11. Any person on the auctioneers premises at any time shall be deemed to be there at his own risk. He shall have no claim against the auctioneers in respect of accident which may occur or injury, damage or loss howsoever caused save insofar as the injury, damage or loss shall be caused by the direct negligence of the auctioneers employees.
