STANDARD TERMS AND CONDITIONS OF BUSINESS

GENERAL: The auctioneer acts only as an agent for the vendor (unless otherwise specifically declared). Lots sold at auction are likely to be subject to wear and tear caused by the user or the effects of age and may therefore have faults or imperfections. Buyers are given enough opportunity during our advertised viewing times to examine lots for authenticity, condition, restoration, etc. before bidding, and will be assumed to have done so. They must rely solely on their own skill or judgement as to whether Lots are fit for any purpose, and not from any materials, description or photography presented by the auctioneer.

CATALOGUE DESCRIPTION: Descriptive statements contained in advertisements or catalogues made up by the auctioneer, or any member of staff, should be taken as matters of opinion only, and shall not be taken as statement of fact. Any lot that includes 'A.F' in the description is sold ‘as found’, and may have some damage and need attention.

BIDDING: By the making of any bid the buyer acknowledges acceptance of these conditions. The buyer shall be the person making the highest bid which is acceptable to the auctioneer as signified by the fall of the hammer. No bid may be retracted, however in the case of a dispute the auctioneer may either declare the purchaser or re-offer the Lot for sale.  

AUCTIONEERS DISCRETION: The Auctioneer has absolute discretion to, (1) refuse any bid, and to regulate the bidding or cancel any sale without giving any reason or previous notice (2) to advance the bidding as he/she may decide, may bid on the vendor's behalf for all goods, which are being offered subject to a reserve or at the Auctioneer's discretion.  (3)  divide any Lot, to combine any two or more Lots, to withdraw any Lot, (4) to exclude any persons from the auction rooms, (5) to require pre-payment in full, (6) to accept offers of not less than 90% of the agreed reserve, (7) All descriptions and statements concerning any Lot; whether in the catalogue or elsewhere are subject to description altering by the Auctioneer from the rostrum prior to the lot being sold.

REGISTRATION: Bidding is by numbered paddle in the auction house, however buyers also register via email and when placing commission bid, by filling in a commission bid form. New buyers will be required to leave cash deposit which will be deducted from the price of any purchase made or refunded in full if they do not buy.

FALL OF THE HAMMER: The highest bidder shall be the buyer. If any dispute arises the Auctioneer has absolute discretion to settle the dispute or re-offer the Lot. At the fall of the hammer the purchaser shall give the Auctioneer his/her name, address and telephone number, and a cash deposit if requested. It is the buyer’s responsibility to make full payment for any Lots purchased by close of business (5pm) by the first Wednesday following the sale.IF THE AUCTIONEER HAS NOT HAD AN COMMUNICATION WITHIN TWO DAYS FOLLOWING THE SALE, ITEMS WILL BE REOFFERED TO THE NEXT SALE, AND THE SALEROOM WILL BE INFORMED, THIS MAY RESULT IN YOUR ACCOUNT BEING SUSPENDED.

FORGERIES AND COMPLAINTS: The buyer should notify in writing WITHIN 7 DAYS OF THE SALE,  that in he/she opinion a Lot is a forgery, or any other discrepancy regarding the Lot in question and is returned to the auctioneer at the buyers cost WITHIN 7 DAYS OF THE SALE to the auction house in the same condition as when bought, then if on considering such evidence as the buyer supplies to prove his assertion, the auctioneer decides that the Lot is a forgery the sale of the Lot will be rescinded and the purchase price repaid to the buyer.

PRIVATE TREATY: In the event of any Lot being sold by private treaty the buyer agrees to be bound by the Conditions of Sale.

BUYERS CHARGES: There is a buyers' premium of 17.5% of the hammer price on each Lot sold. The buyers' premium only is subject to VAT at the standard rate. There is a minimum charge of £3 in respect of buyers' premium on any one Lot. Online bidders that are bidding via thesaleroom.com are charged an additional 4.95%, on top of our commission.

ESTIMATES: These are printed in the catalogue beside the Lot description and do not include the buyers' premium or VAT. They are for guidance only and as they are prepared in advance of the sale they may be subject to revision.

BREAKAGES: Any person on the premises during the period of viewing shall be held responsible for any breakage or damage caused by him/her or young children in his/her care and may be asked to pay for any item or items broken or damaged.

PAYMENTS: It is stipulated that all transactions will be settled by cash, debit/credit cards and bank transfers (details for bank transfers are at te bottom of our invoice). ***WE DO NOT TAKE PAYMENTS AUTOMATICALLY VIA THE SALEROOM***

CLEARING OF PURCHASES:  Once the hammer has fallen the item is your responsibility. The buyer must clear purchases no later than the second working day, following the sale, unless agreed by the auctioneers. Items may be removed at the buyer’s risk and expense. All Lots not collected shall remain at the buyer's risk, and may be subject to a minimum warehousing charge of £2.50 per Lot per day. After 7 days the Auctioneers may re-sell the Lot or Lots by auction or privately, without notice to the buyer, to defray any costs incurred. The Auctioneers disclaim all responsibility for loss, damage or unauthorized removal of uncollected goods.AUCTION CAN HOLD PAID PURCHASES FOR POSTAGE/ COLLECTION FOR ONLINE/ OVERSEAS BUYERS

GOLD AND SILVER: The auctioneers' do not accept any responsibility for the authenticity or purity of any items not bearing British or Irish hallmarks.

ELECTRICAL ITEMS: The auctioneers cannot make any guarantees as to the condition or safety of any Lots wired for electricity. It is recommended that buyers have these items examined by a qualified electrical contractor before use.

COMMISSION BIDS: The Auctioneers will be pleased to accept commissions in writing and email from intending purchasers unable to attend the sale. Printed forms are available for this purpose and must be completed clearly and in full, and if this is not done the Auctioneers reserve the right not to execute the bid or bids. This service is free to prospective buyers and the Auctioneers cannot accept liability for failure to make a commission bid. Instructions given by telephone, in writing or via the Internet are accepted at the buyer's risk and acknowledge acceptance of the Conditions of Sale. Internet bids must be received before the commencement of the sale.

* If there is more than one commission bid on any particular Lot for an identical amount, and these prove to be the highest bids, the Lot will be sold to the person whose bid was received first.

AGENCY: The Auctioneers act as agents only and they disclaim responsibility for either buyer or seller.

INDEMNITY: The buyer shall indemnify the Auctioneer against any claims in respect of any goods sold by them on the vendor's behalf.

THIRD PARTY LIABILITY: Every person on the Auctioneer's premises at any time shall be deemed to be there at his/her own risk and with notice of the condition of the premises and the method of arranging the furniture, etc. He/she shall have no claim against the Auctioneers in respect of any injury sustained or any accident.

ONLINE BIDDING: NL AUCTION ROOMS offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale. In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with NL AUCTION ROOMS you: 1. authorise NL AUCTION ROOMS, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and 2. confirm that you are authorised to provide these credit card details to NL AUCTION ROOMS through www.the-saleroom.com and agree that NL AUCTION ROOMS are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale. Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 4.95% commission charge + VAT at the rate imposed on the hammer price Lots purchased online with the-saleroom.com will attract an additional charge for this service in the sum of 4.95% of the hammer price plus VAT at the rate imposed
