Mit der Teilnahme an der Auktion (persönlich, telefonisch, schriftlich oder über das Internet) werden folgende Bedingungen anerkannt:

VERSTEIGERUNGSBEDINGUNGEN

Allgemeine Geschäftsbedingungen

 

 Mit der Teilnahme an der Auktion (persönlich, telefonisch, schriftlich oder über das Internet) werden folgende Bedingungen anerkannt:

I Allgemeine Bestimmungen

 

(1) Die Versteigerung erfolgt freiwillig.

 

(2) Sie wird vom Auktionshaus WENDL in fremdem Namen für fremde Rechnung durchgeführt. Dies gilt nicht für Eigenware.

 

(3) Jede auftraggebende Person bekommt eine Nummer, sodass aus dem Einlieferungsverzeichnis zu erkennen ist, welche Gegenstände von welcher auftraggebenden Person eingeliefert wurden. Eigenware ist mit der Nummer 11 gekennzeichnet; sie wird für eigene Rechnung in eigenem Namen veräußert.

II Obliegenheit zur Besichtigung und Gewährleistungsausschluss

 

(1) Die Katalogbeschreibungen werden nach bestem Wissen und Gewissen vorgenommen. Sie beruhen zum Teil auf Angaben der Einliefernden. Katalogbeschreibungen sind Meinungsäußerungen und stellen keine Beschaffenheitsvereinbarungen dar. Dies gilt auch für ergänzende Informationen und Zustandsbeschreibungen. Es bleibt vorbehalten, Katalogangaben vor der Auktion zu berichtigen. Sämtliche zur Versteigerung gelangenden Gegenstände können vor der Auktion besichtigt und geprüft werden. Beschädigungen werden im Auktionskatalog nur erwähnt, wenn sie nach Meinung des Auktionshauses WENDL den Gesamteindruck des Objekts deutlich beeinträchtigen.

 

Defekte, Fehler, Klebe- und Fehlstellen etc. werden bei den Limitfestlegungen berücksichtigt. Die Gegenstände werden in dem Zustand versteigert, in dem sie sich befinden. Das Fehlen eines Hinweises besagt nicht, dass der Gegenstand sich in einem einwandfreien Zustand befindet oder frei von Fehlern bzw. Mängeln ist. Bücher, Zeitschriften, Akten u. ä. sind nicht kollationiert. Oberflächenoxidation/Altersschwärzung bei Metallen und Edelmetallen wird nicht gesondert erwähnt. Maßangaben sind teils gerundet und in der Reihenfolge Höhe/Breite/Tiefe angegeben. Signaturen, Marken, u.ä. sind abgelesen, aber nicht geprüft; Irrtum vorbehalten. Zuordnungen sowie Literaturverweise sind Meinungsäußerungen und keine zugesicherten Eigenschaften. Auktionsobjekte sind selbst zu prüfen und die Gelegenheit der Vorbesichtigung wahrzunehmen. Defekte am Rahmen sind meist nicht erwähnt. Rahmen und Verglasungen werden nur als äußerer Schutz für die Bilder bzw. Objekte angesehen; Beschädigungen dieser werden nicht erwähnt und sind in Bewertungen oder Limite nicht einbezogen. Evtl. auch später auftretende Defekte (Transportschäden o.ä.) berechtigen nicht zu Reklamation irgendwelcher Art.

 

Die Angabe einer Autorschaft bei Plastiken/Skulpturen bezieht sich auf den entwerfenden Künstler und eine eventuell angegebene Jahreszahl auf die Entstehungszeit des Entwurfes. Die Ausführung bzw. der Guss/Nachguss kann auch wesentlich später erfolgt sein, gegebenenfalls postum. Farbsteine sind, sofern nicht als „geprüft“ beschrieben, nicht auf Echtheit, mögliche Synthesen, Imitationen, chemische oder technische Aufbereitung bzw. Verbesserung geprüft. Inhalte von vorhandenen Gutachten oder Zertifikaten werden übernommen, stellen jedoch keine Garantie dar. Uhren und Geräte mit enthaltener Technik werden auf Basis ihres dekorativen Wertes und Alters verkauft; von Betriebsfähigkeit kann nicht ausgegangen werden. Zum Verständnis der Beschreibungstexte gelten die „Erläuterungen zur Katalogbeschreibung” (Diesen Bestimmungen als Anlage A beigefügt). In allen Fällen ist der tatsächliche Erhaltungszustand des Gegenstandes zum Zeitpunkt seines Zuschlages die vereinbarte Beschaffenheit im Sinne der gesetzlichen Bestimmungen (§§ 434ff BGB).

 

 

 

(2) Das Auktionshaus WENDL trifft keine kaufrechtliche Gewährleistungspflicht. Rechtzeitig vorgetragene Mängelrügen werden der einliefernden Person übermittelt. Mängel müssen innerhalb eines Jahres nach Übergabe gerügt und ggf. (z.B. bei Verdacht einer Fälschung) eine Expertise eines anerkannten Sachverständigen (auf Kosten des Reklamierenden) spätestens 4 Wochen nach der Auktion beigebracht werden. Ein Annahmeverzug der erwerbenden Person steht der Übergabe gleich. Eine Rückabwicklung lässt den Anspruch des Auktionshauses WENDL auf das Aufgeld unberührt.

 

 

 

(3) Bei der Besichtigung und während der Versteigerung ist größte Vorsicht geboten, da jeder Besucher für den von ihm verursachten Schaden in vollem Umfang einstehen muss. Ansprüche auf Schadenersatz wegen Pflichtverletzungen gegen das Auktionshaus WENDL sind auf Vorsatz und grobe Fahrlässigkeit beschränkt. Dies gilt nicht bei Verletzung von Leben, Körper und Gesundheit, ebenso nicht bei der Verletzung von Kardinalpflichten (Pflichten, die sich aus der Natur des Vertrages ergeben und deren Verletzung die Erreichung des Vertragszweckes gefährdet) und Verzugsschäden. Die Haftung im Fall der Verletzung von wesentlichen Vertragspflichten wird auf den regelmäßig vorhersehbaren Schaden begrenzt.

 

(4) Das Auktionshaus WENDL kann aus besonderen Gründen Personen von der Auktion ausschließen, insbesondere solche Personen, welche die Versteigerung oder Besichtigung stören oder sich im Zahlungs- oder Abholungsverzug befinden. Der Handel und Tausch ist unberechtigten Personen im Auktionshaus WENDL untersagt. Bei Zuwiderhandlung wird Schadensersatz geltend gemacht und Hausverbot erteilt.

III Ablauf der Versteigerung

 

 

 

(1)  Der Aufruf beginnt in der Regel zu dem im Katalog ausgewiesenen Limit-Preis. Gegenstände ohne Limitvorgabe werden mit 20 € aufgerufen, falls nicht mehrere höhere schriftliche Gebote vorliegen. Versteigert wird bis 180 € um 10 €, über 180 € um ca. 10 % oder nach Ermessen des Auktionators. Der Zuschlag wird erteilt, wenn nach dreimaligem Wiederholen des höchsten Gebotes ein Übergebot nicht abgegeben wird oder der von der auftraggebenden Person vorgeschriebene Limitpreis erreicht ist.

 

 

 

(2a) Das Auktionshaus WENDL kann ein Gebot ablehnen, in diesem Fall bleibt das unmittelbar vorher abgegebene Gebot verbindlich. Geben mehrere Bietende gleichzeitig ein gleichlautendes Gebot ab, entscheidet das Auktionshaus WENDL nach eigenem Ermessen. Uneinigkeiten über das letzte Gebot oder einen Zuschlag können durch nochmaliges Angebot der Sache behoben werden. Dies gilt auch dann, wenn ein rechtzeitig abgegebenes höheres Gebot übersehen worden ist. Wenn eine höchstbietende Person ihr Gebot nicht gelten lassen will, so kann das Auktionshaus WENDL dieser trotzdem den Zuschlag erteilen und die sich hieraus ergebenden Rechte weiterverfolgen. Es kann aber auch den Zuschlag dem nächstniedrigeren Gebot erteilen oder den Gegenstand neu aufrufen. Der Zuschlag verpflichtet zur Abnahme und zur Zahlung. Mit ihm geht die Gefahr für etwaige Verluste, Beschädigungen, Verwechslungen usw. auf die erwerbende Person über. Jede bietende Person kauft im eigenen Namen und auf eigene Rechnung.

 

Möchte eine bietende Person im Auftrag anderer steigern, haftet diese persönlich für Abnahme und Zahlung, auch wenn die Rechnung auf die auftraggebende Person ausgestellt ist. Der gesamte von der erwerbenden Person zu entrichtende Betrag ist sofort fällig und in bar oder im Kreditrahmen seiner EC-Karte am Tage der Auktion beim Auktionshaus WENDL einzuzahlen. Von neuen erwerbenden Personen bzw. Kundschaft ohne bisherigen Umsatz werden Schecks nur mit Bankbestätigung entgegengenommen. Das Auktionshaus WENDL behält sich vor, Sicherheiten zu verlangen (Referenzen, Bardepot u.ä.). Bei Erwerb durch schriftlich oder durch online LIVE-Bieten erteilten Zuschlag ist die Gegenleistung innerhalb von 8 Tagen nach Rechnungsdatum zu erbringen. Bei Nichteinhalten der Zahlungsfrist werden der erwerbenden Person 1% Zinsen pro angebrochenem Monat berechnet; eine Aushändigung der Ware erfolgt erst nach vollständiger Bezahlung der Ware und Verzugszinsen. Zeitpunkt des Zahlungseingangs ist das Eingangsdatum auf dem Kontoauszug des Auktionshauses WENDL bzw. der Zahlungseingang bei dem vom Auktionshaus autorisierten Zahlungsanbieter (z.B. Stripe bei Online-Zahlung auf der Website).

 

 

 

(2b) Telefongebote können nur für Objekte beauftragt werden, die mit 150 € oder höher limitiert sind. Ein Telefongebot bedeutet in jedem Fall das Bieten des Limitpreises. Telefonbietende haben die Möglichkeit, ein über dem Limit liegendes Sicherheitsgebot (SG) in Auftrag zu geben. Ist die bietende Person zum Zeitpunkt des Aufrufes telefonisch nicht erreichbar, so bietet das Auktionshaus WENDL bis zur Höhe des Sicherheitsgebotes im Auftrag mit. Eine Garantie für das Zustandekommen der Telefonverbindung kann nicht übernommen werden. Liegt kein Sicherheitsgebot vor, ist im Falle einer Nicht-Erreichbarkeit nur das Limit geboten. Gebote unter dem Limit sind als Telefongebot nicht möglich.

 

 

 

(2c) Versand: Ab 2024 übergeben wir den Versand an den externen Versanddienstleister Mail Boxes ETC Zwickau (MBE). Kunden, die keine Abholung in Ihrem Kundenkonto eingestellt haben (entweder per Login auf auktionen.auktionshauswendl.de/de/user-settings oder per Kommunikation mit dem WENDL-Team), erhalten in der ersten Woche nach der Auktion ein Versandangebot von MBE. Dieses Angebot kann auch über einen Link in der Online-Rechnung angefordert werden. Der Versand erfolgt nach Auftrag des Kunden, jedoch nicht bevor die WENDL-Rechnung und die MBE-Versandkostenrechnung bezahlt wurde. Wir verweisen in diesem Zusammenhang ausdrücklich auf unsere Datenschutzerklärung (online unter https://www.auktionshauswendl.de/tcms/ueber-uns/datenschutz  oder vor Ort durch Aushang im Auktionshaus.)

 

Sollte der Auftrag nicht an MBE erteilt werden, steht es Ihnen frei einen eigenen Versanddienstleister zu beauftragen, der für die Abholung verantwortlich ist. Die Übergabe an den Versanddienstleister erfolgt auch in diesem Fall erst nach Begleichung der WENDL-Rechnung.

 

 

 

Wir weisen darauf hin, dass Im- bzw. Exportbeschränkungen, insbesondere außerhalb der Europäischen Union, für bestimmte Objekte und Materialien (wie z.B. Elfenbein, Rhinozeroshorn und Schildpatt) gelten. Diese könnten der Ein- und/oder Ausfuhr der Gegenstände, inkl. des postalischen Versands, entgegenstehen. Die erwerbende Person ist selbst dazu verpflichtet, sich darüber zu informieren, ob ein von ihm erworbener Gegenstand solchen Beschränkungen unterliegt, ob und wie eine nötige Genehmigung eingeholt werden kann und diese ggf. dem beauftragten Versanddienstleister, Mail Boxes Etc. Zwickau, zum Zweck des Versands zur Verfügung zu stellen. Etwaige in diesem Zusammenhang entstehende Kosten, Zölle, Abgaben etc. sind von der erwerbenden Person zu tragen.

 

Bei der Ausfuhr von Waren ab einem Gesamtwarenwert von 1.000,– € ist die Erstellung einer Ausfuhranmeldung beim Zoll zwingend erforderlich. Diese Anmeldung kann vom beauftragten Versanddienstleister, Mail Boxes Etc. Zwickau, durchgeführt werden. Bitte setzen Sie sich hierzu mit Mail Boxes Etc. Zwickau in Verbindung. Bei Ausfuhr durch die erwerbende Person bzw. durch von dieser Person anderweitig beauftragte Versandunternehmen muss die Ausfuhranmeldung von der erwerbenden Person oder deren Versandunternehmen durchgeführt werden. Bei Ausfuhr sowohl innerhalb als auch außerhalb der EU sind (inter-)nationale Gesetze und Abkommen zu beachten, unter das deutsche Kulturgutschutzgesetz von 2016, das Europäische Kulturgüterschutzabkommen von 1993, das CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora), die UNESCO-Konvention von 1970 etc.“

 

(3) Jeder Zuschlag in der Auktion unter dem Limit ist automatisch ein Vorbehaltszuschlag, auch wenn dies nicht in jedem Fall einzeln angesagt wird. In diesem Fall ist die bietende Person vier Wochen an ihr Gebot gebunden. Das Objekt kann jedoch jederzeit ohne Rückfrage an eine höherbietende Person abgegeben werden.

 

 

 

(4) Das zugeschlagene Gebot ist der Nettopreis. Auf diesen Zuschlagspreis wird ein Aufgeld von 21% plus der gesetzlichen Mehrwertsteuer von derzeit 19% auf das Aufgeld erhoben. Da die USt. nur auf das Aufgeld (Provision des Versteigerers) erhoben wird, ist eine USt-Erstattung bei Ausfuhr ins Ausland nicht möglich. Für Zuschläge, die über das LIVE-Bieten erfolgen, wird eine zusätzliche Gebühr von 3% (WENDL-LIVE über www.auktionshauswendl.de) bzw. 5% (über externe Auktionsportale) plus USt. erhoben.

 

 

 

(5) Der Zuschlag verpflichtet zur Abnahme und Zahlung des Kaufpreises (Zuschlagspreis und Aufgeld plus USt. auf das Aufgeld) an das Auktionshaus WENDL oder eine beauftragte Person des Auktionshauses WENDL. Mit der Erteilung des Zuschlages gehen Besitz und Gefahr unmittelbar auf die erwerbende Person über; das Eigentum wird erst nach vollständiger Bezahlung des Kaufpreises übertragen. Eventuelle Beanstandungen werden nur bei bezahlten Objekten bearbeitet.

 

 

 

(6) Bleibt die erwerbende Person mit der Annahme der ersteigerten Gegenstände oder der Zahlung des fälligen Kaufpreises im Rückstand, so ist das Auktionshaus WENDL berechtigt, auf Abnahme zu klagen, Schadensersatz wegen Nichterfüllung zu fordern oder vom Vertrag zurückzutreten. Will das Auktionshaus WENDL Schadensersatz, so kann unbeschadet der Möglichkeit, einen höheren tatsächlichen Schaden geltend zu machen, 36% der Zuschlagssumme als pauschalierte Entschädigung ohne Nachweis gefordert werden. Das Auktionshaus WENDL ist berechtigt, neben eigenen auch alle Ansprüche der Einliefernden gegen Erwerbende gerichtlich und auch außergerichtlich geltend zu machen. Das Auktionshaus WENDL kann jederzeit vom Erfüllungs- zum Schadensersatzanspruch übergehen.

 

 

 

(7) Jede Lagerung und Verpackung erfolgt grundsätzlich auf Kosten und Gefahr der erwerbenden Person.

 

 

 

(8) Ersteigerte Gegenstände müssen bis spätestens 4 Wochen nach der Auktion abgeholt werden. Andernfalls erheben wir Lagergebühren pro Tag und Gegenstand von 1 € bis 3 €. Überschreitet die Lagerung bereits bezahlter, aber nicht abgeholter Gegenstände 4 Monate, ist das Auktionshaus WENDL berechtigt, aber nicht verpflichtet, zur Deckung der Lagergebühren die Gegenstände ohne nochmalige Rückfrage ohne Limit in einer der nächsten Auktionen noch einmal zu versteigern. Etwaige Resterlöse werden der ursprünglichen erwerbenden Person gutgeschrieben, noch fehlende Beträge vom Auktionshaus WENDL eingefordert.

 

 

 

(9) Durch die Inanspruchnahme der Services des Auktionshauses WENDL, z.B. durch Kontaktaufnahme, Einlieferung, Gebotsabgabe, etc. werden zu diesen Zwecken gemäß DS-GVO relevante Daten vom Auktionshaus WENDL erhoben, verarbeitet und gespeichert. Mit der Nutzung der Angebote des Auktionshauses WENDL erklären Sie sich mit der Datenschutzerklärung einverstanden, welche im vollen und aktuellen Umfang stets unter www.auktionshaus-wendl.de zur Verfügung steht. (10) Die Ausführung schriftlicher, telefonischer oder LIVE-Gebote ist ein zusätzlicher Service des Auktionshauses WENDL. Eine Zusicherung für deren Ausführung bzw. fehlerfreie Durchführung wird nicht gegeben.

 

 

 

(11) Das Auktionshaus WENDL behält sich das Recht vor, Nummern des Katalogs zu vereinen, zu trennen, außerhalb der Reihenfolge anzubieten oder zurückzuziehen.

IV Versteigerung von Objekten des Dritten Reichs

 

Sofern das Auktionshaus WENDL Objekte des Dritten Reichs versteigert, erfolgt dies allein zu Zwecken der staatsbürgerlichen Aufklärung, der Abwehr verfassungswidriger Bestrebungen, der Kunst oder Wissenschaft, der Forschung oder der Lehre, der Berichterstattung über Vorgänge des Zeitgeschehens oder der Geschichte oder zu ähnlichen Zwecken.

V Erfüllungsort

 

Erfüllungsort ist Rudolstadt. Es gilt deutsches Recht; das UN-Abkommen über Verträge des internationalen Warenverkaufs (CISG) findet keine Anwendung.

VI Freihändiger Verkauf

 

Die vorstehenden Bedingungen gelten entsprechend auch für den freihändigen Verkauf.

VII Schlussbestimmungen

 

 

 

(1) Die Versteigerungsbedingungen, Einlieferungsbedingungen sowie allgemeinen Geschäftsbedingungen des Auktionshauses WENDL regeln sämtliche Beziehungen des Auktionshauses WENDL mit der erwerbenden Person. Allgemeine Geschäftsbedingungen der erwerbenden Person haben dementsprechend keine Geltung.

 

 

 

(2) Sollte eine Bestimmung dieser Versteigerungsbedingungen ganz oder teilweise nicht wirksam sein, so bleibt die Gültigkeit der übrigen davon unberührt. Die Parteien haben die unwirksame Bestimmung durch eine wirksame zu ersetzen, die dem erstrebten Zweck möglichst nahekommt. Entsprechendes gilt für ergänzungsbedürftige Lücken im Vertrag.

 

 

 

Die deutsche Fassung der Versteigerungsbedingungen und die Anwendung des deutschen Rechts ist in jedem Falle maßgeblich – Übersetzungen in andere Sprachen dienen lediglich der inhaltlichen Orientierung.

 

 

 

Anlagen: A) Erläuterungen zur Katalogbeschreibung

ANLAGE A): ERLÄUTERUNGEN ZUR KATALOGBESCHREIBUNG

KATALOGBESCHREIBUNGEN werden von uns nach bestem Wissen und Gewissen vorgenommen. Die Gegenstände sind überwiegend alt und weisen meist Alters- und Gebrauchsspuren auf. Zustandsbeschreibungen sind als Orientierungshilfe gedacht. Unserer Meinung nach gravierende Mängel werden beschrieben. Das Fehlen eines solchen Hinweises besagt nicht, dass sich der Gegenstand in einwandfreiem Zustand befindet oder frei von Mängeln ist. Es besteht Obliegenheit zur Vorbesichtigung, bei der ausreichend Zeit und Gelegenheit gegeben wird, sich selbst ein Bild vom Zustand der Ware zu machen. Reklamationen, gleich welcher Art, können nach der Auktion nicht berücksichtigt werden.

Für Katalogtexte werden untenstehende Angaben (und deren Abkürzungen) wie folgt definiert:

Maßangaben: Maßangaben werden in cm, in der Reihenfolge Höhe x Breite x Tiefe angegeben. Bei zwei Angabengruppen bezieht sich die letztere auf die Rahmengröße.

Name ohne Zusatz: Unserer Meinung nach in Gänze ein Werk des angegebenen Künstlers.

„zugeschrieben”: Unserer Meinung nach wahrscheinlich in Gänze oder in Teilen ein Werk des angegebenen Künstlers.

„Werkstatt/Schule”: Unserer Meinung nach aus der Werkstatt des angegebenen Künstlers, vermutlich unter seiner Aufsicht.

„Umkreis”: Unserer Meinung nach ein Werk, das den Einfluss des angegebenen Künstlers zeigt.

„Nachfolge”: Unserer Meinung nach ein Werk im Stil des genannten Künstlers, aber nicht notwendigerweise von einem seiner Schüler. Ohne verbindliche Angabe der Zeit.

„nach”: Unserer Meinung nach eine Kopie eines Werkes des angegebenen Künstlers.

„Art des”: Unserer Meinung nach ein Werk im Stil des angegebenen Künstlers zu späterer Zeit.

Titel in „...”: Auf dem Werk befindlicher, zeitgenössischer Titel oder in Nachschlagewerken geführter Titel.

„signiert/monogrammiert/datiert”: Sofern nicht zusätzlich eingeschränkt ist das Werk unserer Meinung nach von der Hand des Künstlers signiert und/oder monogrammiert und/oder datiert.

„bezeichnet”: Unserer Meinung nach ist das Werk von anderer Hand signiert/datiert.

Name oder Datierung in ( ): recherchierte Ergänzungen. „Wohl“: Vermutung aufgrund unserer Recherchen – diese stellen keine Zusicherungen dar.

Die im Katalog beschriebenen UHREN werden auf Gangfähigkeit, nicht jedoch auf Ganggenauigkeit oder Gangdauer geprüft. Startet das Werk nach Aufzug reibungslos, „läuft“ die Uhr. Bleibt eine Uhr nach Aufzug des Werkes kurze Zeit später stehen, wird die Uhr mit „läuft an“ klassifiziert. Ein nicht gangbares Werk wird mit „läuft nicht“ beschrieben. Die im Katalog getroffenen Aussagen dienen lediglich als Information und sind als Meinung zu verstehen. Sie beinhalten keine Garantie, für die WENDL haftbar gemacht werden könnte.

By participating in the auction in person, via telephone, in writing, or via the Internet, you agree to the following terms:

I  GENERAL TERMS

(1) Participation in the auction is voluntary.

(2) Wendl Auctioneers (herinafter referred to as the "Auctioneer", "we", or "us") conduct the sale on behalf of and for the account of a third party. This does not apply to objects put up for sale by the Auctioneer on his behalf and for his account.

(3) Each consignor is assigned a number to enable the Auctioneer to track the consigned lots. Lot no. 11 is reserved for objects put up for auction by the Auctioneer on his behalf and for his account.

II  PRE-SALE EXHIBITION, GUARANTEE, AND LIABILITY

(1) The Auctioneer makes every effort to ensure the accuracy of the catalogue descriptions. They rely in part on information given by the consignors. However, the descriptions are qualified statements of opinion only and are no warranties or agreement on the legal and factual nature of the lots. Clocks, watches and other lots with mechanical features are sold on the basis of their decorative value and age; they are not assumed to be in working condition. In all cases, the true condition of the lot at the time of sale is the agreed upon condition (vereinbarte Beschaffenheit) according to the applicable German legislation §§ 434ff BGB).

(2) The Auctioneer assumes no liability for the catalogue descriptions and does not guarantee the age, origin, size, weight, signatures, hallmarks, material, or damages of the objects offered in the sale. In instances, where a buyer informs us about a defect within the specified legal period of liability, we will get on touch with the consignor to address the issue. Any claims must be made within one year of the collection of goods. In special cases, such as when a lot’s authenticity is in question, we will work with the purchaser to remedy the situation vis-à-vis the consignor. In this case the purchaser is required to obtain, at his expense, a written expertise from a recognised expert in the field within four weeks following the sale. A late collection of his/her goods is considered equal to having handed over the object at the usual time after the sale. The auctioneer may still claim comission fees on a returned object.

(3) We advise visitors to use caution when visiting the pre-sale exhibition and attending the auction as they are liable for any damage they may cause. Any claims for indemnity or compensation because of violations of duty by the auction house are limited to criminal intent or gross negligence.

(4) The auctioneer reserves the right to exclude persons from the sale, specifically if they disturb the preview or sale and/or if they have open bills to settle or lots overdue for collection. Trade and exchange of goods is not permitted to unauthorised persons on the premises. If discovered, indemnity claims might be made on behalf of the auction house and a ban on entering the house issued.

III  THE AUCTION

(1) A lot is usually called to auction at the reserve noted in the catalogue. Lots without a reserve are called at Euro 10,00, unless we have in hand several higher written bids. Bids up to the amount of Euro 180,00 increase in steps of Euro 10,00, bids above Euro 180,00 increase by approximately 10%. The winning bid is arrived at when all but one bidder drop out, the Auctioneer has repeated the last bid three times, does not obtain a higher bid, and when the reserve is met. The final bidder is the successful buyer. The Auctioneer brings down his gavel on the rostrum and declares the final hammer price.

(2a) The Auctioneer, at his sole discretion, may reject a bid. In that case the preceding bid becomes the winning bid. If several bidders offer the same amount, the Auctioneer decides over the bid. Disagreements over a bid may be resolved, at the Auctioneer’s discretion, by calling for a repeat of the bid in question. This may also be done in cases where the Auctioneer may have missed or overlooked a higher bid. If the winning bidder refuses to honor his bid, the Auctioneer is entitled to award the lot to him and to avail himself of any legal remedies to force completion of the sale. He may also, at his sole discretion, award the winning bid to the preceding highest bidder or may call up the lot in question again. Once the Auctioneer’s gavel falls, the successful bidder immediately assumes full risk and responsibility for the purchased lot, including the risk of loss, damage, etc. Each bidder buys on his behalf and for his account. A bidder who acts on behalf of a third party is personally liable for payment and removal of the purchase, even if the invoice is in the third party’s name. The purchaser is required to make full payment in cash at the end of the auction. New customers who do not pay in cash are required to submit a banque approved cheque. The Auctioneer reserves the right to request securities (i.e. references, cash deposit, etc.). Purchasers, who submitted a written bid, are required to make payment in full within 10 days upon receipt of our invoice. Customers who fail to pay their invoice within the specified time frame incur interest charges of 1% of the billed amount per month. The goods will be released to the purchaser upon payment of all charges. We credit your account as soon as payment has been posted to our banque account.

(2b) Telephone bids are taken for objects with a reserve of Euro 240,00 and above. We do not accept bids below the reserve from telephone bidders; therefore, when bidding by telephone the bid must be at the reserve. Telephone bidders may provide us with a second bid (safety bid) that is higher than the reserve, in case the bidder cannot be reached by telephone when the desired lot is being auctioned. In this case the Auctioneer will continue to bid up to the amount of the safety bid. If we don’t receive a safety bid, we bid at the reserve. We cannot guarantee for the telephone or online LIVE connection during the auction.

(2c) If you would like us to ship your objects upon payment, please note the following: We require a written request from absentee bidders to ship the purchase. Inclusion of the quoted flat rate shipping charge with payment represents an order to ship the goods. We exclusively use the services of DHL and ship at the purchaser’s risk. However, possible damages to the lots that occured due to shipping via DHL are insured by us via Artima Insurance (by Mannheimer Insurances) up to the following sums: 25.000 Euro within Germany, 10.000 Euros for shipment outside of Germany, and 5.000 Euros for jewellery in both cases. Please contact us for additional insurance if needed.
The flat rate for shipping within Germany includes postage and handling and, depending on size and weight, ranges from Euro 8,00 to ca. 30,00. We can ship up to a package size of 120x 60x60 cm. We do not ship large paintings, graphic art framed in glass, fragile objects, porcelain or glass sets, etc. We require removal of purchases within three weeks, as we do not have sufficient storage facilities on the premises, else the goods will be stored at the purchaser’s risk and expense at a cost of Euro 1,00 to Euro 3,00 per item per day.
We hereby point out that import and/or export restrictions, especially but not exclusively outside of the European Union, might apply to specific objects and materials (including ivory, rhino tooths, tortoise shell, etc.). This might restrict or prohibit the import or export of such lots, including postal shipping. It is the buyer's responsibility to inform him-/herself if a lot sold to him/her is subject to such restrictions and if and how an export license or similar needs to be requested. He/she then needs to make such documents available to the auction house if they are to send the lots on their behalf. Any costs, taxes, fines or similar occuring on this account must be paid for by the buyer. A combined value of lots of 1.000 € always demands an export declaration to be made to the German customs authorities. We, the auction house will provide those necessary documents in the case of DHL-shipping of the lots - for any other modes of goods collection the buyer has to do so himself. National as well as international laws and conventions must be observed when exporting lots within and outside of the EU (e.g. the German "Kulturgutschutzgesetz" (Law for the Protection of Cultural Goods) from 2016. the European Cultural Goods Convention from 1993 and the UNESCO Convention from 1970).

(3) Any winning bid below the reserve automatically becomes a conditional sale, even if this is not specifically stated. In this case, the bidder is bound by his bid for four weeks. However, at any time, the lot may be awarded to a bidder offering the reserve price or to a bidder, who makes a higher bid.

(4) The hammer price is a net price, to which a buyer’s premium of 21% is added. To the buyer’s premium a value added tax of 19% is added, resulting in a total buyer’s premium of 24.99%. The value added tax is payable on the buyer’s premium only and is non-refundable in case the goods are exported. For a lot won through online LIVE-Bidding, we additionally surcharge (on the hammer price) 3 % + VAT for the WENDL-website, Lot-tissimo & The Saleroom and 5 % + VAT for Invaluable.

(5) The winning bidder is required to complete the purchase and to make payment in full. He assumes ownership, full risk and responsibility for the purchased lot, including the risk of loss, damage, etc. The goods are transferred into his possession upon full payment.

(6) If the buyer does not collect his object(s) in a timely manner, the Auctioneer may use any available legal remedies to force compliance or may cancel the sale. If the Auctioneer demands compensation, he is entitled to claim 30% of the hammer price as a lump sum but, at his discretion, he may also pursue a claim for higher compensation. Further, the Auctioneer is entitled to pursue, in addition to his own claim, a claim of the consignor in or outside of court. The Auctioneer, at any given time, may switch from a claim for performance to a claim for damages.

(7) Packing and storage of goods is done at the buyer’s risk and expense. Items not collected in a timely manner incur customary storage and handling charges. All objects are shipped by mail at the buyer’s risk and expense, unless other arrangements were made with us in writing. Inclusion of the shipping charges with your payment constitutes an order to ship the merchandise.

(8) The Auctioneer is entitled to offer paid for goods that have not been collected within four months after the sale in a future auction at no reserve in lieu of compensation for storage expenses. Any proceeds above the Auctioneer’s expenses are refunded to the customer. In cases where the proceeds do not cover the Auctioneer’s expenses, the customer is liable for the difference.

(9) When using our services, e.g. by contacting, consigning, bidding with us or similar, we will collect, process, and store personal data in order to provide those services according to the GDPR. By using our services, you agree with our Data Privacy Policy, which can always be found in its most up-to-date version on Data Privacy Policy.

(10) The approval of written bids, telephone bookings or online LIVE bidding is an additional service of our house. We do not guarantuee any processing or executing without fault.

IV SALE OF OBJECTS FROM THE THIRD REICH

Insofar as objects from the Third Reich are offered at auction, this is done solely for the purpose of enlightenment or warding off of anti-constitutional activities, for artistic, scientific, research, educational, historic, and similar purposes.

V PLACE OF FULFILMENT

The place of performance is Rudolstadt. The applicable legal jurisdiction is Germany; the UN Agreement CISG is not applicable.

VI POST-AUCTION SALE

The above stated terms and conditions also apply to the Post Auction Sale.

IX FINAL PROVISIONS

In case any provision of the Terms & Conditions of Sale is rendered ineffective, the rest of the legal provisions remain effective. The parties agree to substitute the former with a provision that serves the intended purpose. This also applies to grave omissions of provisions necessary in the contract.

In case of discrepancies between the German and English text of the Terms & Conditions of Sale the provisions in German shall prevail - any translation into other languages is merely done for informative purposes.

For catalogue descriptions of the category "Paintings" („Gemälde”) we define the used terminology as followed: 

 

Measurements: Measurements are made in centimetres, in the order of height x width. If two sets of measurements are given, the latter applies to the frame. 

„zugeschrieben”: According to our opinion probably completely or in parts a work of the referenced artist. 

„Werkstatt/Schule”: According to our opinion from the workshop of the referenced artist, probably made under his/her supervision.  

„Umkreis”: According to our opinion a work made during the lifetime of the artist and showing his/her influence, alhtough not made by his/her hand. 

„Nachfolge”: According to our opinion a work made in the style of the artist but not necessarily by one of his students and without any binding judgement of its time of execution. 

„nach”: According to our opinion a copy of a work by the referenced artist. 

„Art des”: According to our opinion a work in the style of the referenced artist made posthumously/at a later point in time. 

Titel in „...”: The title is either given on the work itself or a commonly used title to be found in common reference material. 

„signiert/monogrammiert/datiert”: If not further restricted by the rest of the catalogue description, we assume the work to be signed ("signiert"), monogrammed ("monogrammiert"), or dated ("datiert") by the artist him-/herself.

By participating in the auction in person, via telephone, in writing, or via the Internet, you agree to the following terms:

(3) Each consignor is assigned a number to enable the Auctioneer to track the consigned lots. Lot no. 11 is reserved for objects put up for auction by the Auctioneer on his behalf and for his account.

Customers who have not set up a collection in their customer account (either by logging in to auktionen.auktionshauswendl.de/de/user-settings or by communicating with the WENDL team) will receive a shipping offer from MBE in the first week after the auction. This offer can also be requested via a link in the online invoice. The shipment will be made according to the customer's order, but not before the WENDL invoice and the MBE shipping costs invoice have been paid.

We create the catalogue description to the best of our knowledge and beliefes. Please note that the lots in our auction are mostly antique and of a certain age and therefore show signs of aging and usage. The condition described in the lot texts is meant for orientation, only and is meant to give an overall idea of the lot’s condition. We aim to mention those defects that gravely impact the perception and value of a lot. The lack of a lot’s condition being described in the lot text does not guarantee that the lot is free of such defects nor signs of aging. We expect our clients to personally view the lots during the auction preview which provides the opportunity to investigate the condition of each lot in person. We cannot accept returns after a sale made on the basis of the condition of a lot.

Within the catalogue, we use the following terms and abbreviations in order to describe the lots. Please refer to the GERMAN lot text in order to get an accurate lot description as all English lot texts are automated translations made by deepl.

Dimension: We measure in centimeters, in order of height x width x depth. If there are two dimensions, the latter will refer to the frame.

Name without further additions: We believe the artwork to be a work by the named artist.

„zugeschrieben”:  We believe it probable that the artwork is in whole or in part a work by the mentioned artist.

„Werkstatt/Schule”: We believe the artwork to be from the workshop of the mentioned artist, probably created under the supervision of the artist.

„Umkreis”: Translates to “circle of”. We believe the artwork to be showing the influence of the named artist.

„Nachfolge”: Translates to “follower”. We believe the work to be in the style of the named artist, not necessarily done by one of his pupils. We do not guarantee the work to originate from any certain time period.

„nach”: Translates to „after“. We believe the artwork to be a copy of a work by the named artist – the copy being done by a different artist.

„Art des”: Translates to „style of“. We believe the work to be done in the style of the artist at a later time.

Title in „...”: If we cite the title in citation marks, this title is either found on the artwork itself or is a known title used in literature.

„signiert/monogrammiert/datiert”: Translates to „signed/monogrammed/dated”. If not listed with any further explanations or disclaimers, we believe the artwork to be signed and/or monogrammed and/or dated by the artist themselves.

„bezeichnet”: Translates to „titled“. We believe that someone else than the artist has signed and/or dated the artwork.

Name oder Datierung in ( ): If we give the name or date in () brackets, then this data is known to us due to research or experience and not to be found on the artwork itself.

 „Wohl“: Translates to „probably“. Due to our research, we believe this data/attributions/dates, etc. to apply. We do not guarantee for those lot properties.

We do check all CLOCKS and WATCHES to test whether they might start running. We do, however, not check how accurately or for how long those clocks and watches run once activated. If they start running without problems, we declare this as. „läuft“ (translates to “running”). If a clock or watch stopps running shortly after we have started it, we declare it as „läuft an“ (translates to “starts running”). If we do not succeed in getting the clock or watch running, we declare it as „läuft nicht“ (not running). Those catalogue descriptions are our believes, only, and are to be used as non-binding information.
