CONDITIONS OF THE SALE

1. The HIGHEST bidder shall be the Purchaser, subject to the right of the Auctioneer to refuse the bidding of any person. Should any dispute arise between bidders, or between the auctioneers and any bidder, the lot in dispute shall be put up again and resold or not AT THE DISCRETION OF THE AUCTIONEER, who shall be the sole arbitrator. The advance in the bidding will be regulated by the Auctioneer and no bidding shall be retracted. Vendors reserve the right to bid by themselves, by their Agents, or by the Auctioneer.

2. The Auctioneers reserve the right to withdraw any lots from the Sale or to divide any lot or lots, or to place two or more lots together, or to alter the order of the lots; previously to or at the time of the Sale should they deem any or either of these courses advisable.

3. The Auctioneers act as agents only. Each lot as set out in the catalogue, or as divided or joined with any lot or lots at the sale at the sole discretion of the Auctioneers, is sold with all faults, imperfections and errors of description, and neither the vendor nor the auctioneers are responsible for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot. All statements in the catalogue as to any such matters are statements of opinion, and are not, nor are to be taken as or as implying, statements or representation of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any lot. Neither the vendor nor the Auctioneers make or give, nor has any person in the employment of the auctioneers any authority to make or give any representation or warranty, and in any event neither the vendor nor the Auctioneers are responsible for any representation or warranty for any statement in the catalogues.

4. Each and every lot shall, at the fall of the hammer, be considered as delivered to the Purchaser, who must thereafter take all risk and responsibility.

5. The Purchasers are able to give their names and places of abode and to pay down immediately (if required) a deposit of 25 pence in the £ or such other sum as the Auctioneers may name, as part payment, such deposit to be applicable to all or any of the lots purchased as the Auctioneer may decide.

6. All the lots are to be paid for and taken away at the buyer’s expense and risk, by Monday following the sale, before 4pm. In cases where the buyer purchases more than one lot the whole of the amount of the lots purchased is to be paid before any one lot is delivered. No person is to be entitled to anything not described in the lots. No allowance whatever will be made for errors in description, quality or quantity. Lots will NOT be transferred from one purchaser’s ticket to another.

7. The Purchaser to be answerable for all damage they, their carriers or other agents may do to any lots or to the premises in taking down or removing their respective lots, and to properly repair the same before their lots are to be removed from the premises, or deposit with the Auctioneers such sums of money as the auctioneer may determine to cover the cost of making good such damage.

8. Upon failure to comply with the above conditions the amount deposited shall be forfeited; all lots left after the specified time will be entirely at the purchaser’s risk and will be charged warehouse rent at the rate of £2 per lot per week or part of plus a £10 handling charge, from and including the day following the day of sale, or may be re-sold either by public sale or private contract, when the Vendors or the Auctioneers think proper without notice to the defaulter, and the deficiency (if any) by such second sale, together with all charges attending the same and any other lots the Vendors may sustain shall be made good by the defaulter or defaulters at this present sale and be recoverable as and for liquidated damages, but any surplus that may arise on the re-sale of uncleared lots shall belong to the vendors. The Auctioneers or Vendors shall have full right to enforce any contract made at this sale whether a deposit has been paid or not and to sue for the full price of the goods and the foregoing provision as to re-sale shall be entirely without prejudice to such right.

NB: cheques will not be taken in payment of goods prior to removal without a Banker’s card unless the purchaser is known to the Auctioneers.

9. DROIT DE SUITE. Prospective bidders should familiarize themselves with the new Droit de Suite regulations now in effect. Any paintings, prints, photographs, sculpture, or other original works of art by living artists and selling for over 1000 Euros, are subject to a 4% royalty. This charge will be shared between the buyer and the vendor (2% each), and is not subject to VAT. Royalty payments collected by Rye Auction Galleries are paid to DACS, the Government appointed body, for distribution to the original artists.

10. Online Bidding
Rye Auction Galleries offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale.
In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Rye Auction Galleries:
authorise Rye Auction Galleries, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
confirm that you are authorised to provide these credit card details to Rye Auction Galleries through www.the-saleroom.com and agree that Rye Auction Galleries are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.

Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price

11. Rescission
Notwithstanding any other terms of these conditions, if within seven days after the sale Rye Auction Galleries have received from the Buyer of any lot notice in writing that in his view the Lot is a deliberate forgery and within 14 days after such notification the Buyer returns the same to Rye Auction Galleries in the same condition as at the time of sale and by producing evidence, the burden of proof to be upon the Buyer, satisfies Rye Auction Galleries that considered in the light of the entry in the catalogue the Lot is a deliberate forgery, then the sale of the lot will be rescinded and the purchase price of the same refunded within 7 days of the vendor refunding to Rye Auction Galleries the amount paid to the vendor in respect of the Lot. The Seller and the Buyer agree to be bound by Rye Auction Galleries decision.
