Terms & Conditions


STANDARD TERMS AND CONDITIONS OF BUSINESS

GENERAL: Every Lot is sold with all faults and errors of description, the Auctioneers disclaim for themselves and for the vendor all responsibil¬ity for authenticity, age, attribution, authorship, period, origin, quality or condition. All statements on such matters whether printed in the catalogue or made orally are statements of opinion and not representations of fact. Purchasers are expected to satisfy themselves on authenticity, condition, restoration, etc. before bidding. Any lot that includes 'A.F' in the description is sold as seen, and may have some damage that needs attention. 

BIDDING: The Auctioneer has absolute discretion to divide any Lot, to combine any two or more Lots, to withdraw any Lot, to refuse any bid and to regulate the bidding or cancel any sale without giving any reason or previous notice. The Auctioneer may bid on the vendor's behalf for all goods, which are being offered subject to a reserve or at the Auctioneer's discretion. All descriptions and statements concerning any Lot, whether in the catalogue or elsewhere, are subject to any statements altering or affecting the same made by the Auctioneer from the rostrum prior to the Lot being offered for sale.

* By the making of any bid the buyer acknowledges acceptance of these conditions.

REGISTRATION: Bidding is by numbered paddle, and/or pre-bid, phone bid, and prospective buyers must register before they bid. New buyers will be required to leave cash deposit which will be deducted from the price of any purchase made or refunded in full if they do not buy.

FALL OF HAMMER: The highest bidder shall be the buyer. If any dispute arises the Auctioneer has absolute discretion to settle the dispute or re-offer the Lot. At the fall of the hammer the purchaser shall give the Auctioneer his/her name, address and telephone number, and a cash deposit if request¬ed, in default of which the Auctioneer may re-offer and re-sell the Lot or Lots concerned. PRIVATE TREATY: In the event of any Lot being sold by private treaty the buyer agrees to be bound by the Conditions of Sale.

BUYERS' PREMIUM: There is a buyers' premium of 15% of the hammer price on each Lot sold. The buyers' premium only is subject to VAT at the standard rate. There is a minimum charge of £2 in respect of buyers' premium on any one Lot.

ESTIMATES: These are printed in the catalogue beside the Lot description and do not include the buyers' premium or VAT. They are for guidance only and as they are prepared in advance of the sale they may be subject to revision.

BREAKAGES: Any person on the premises during the period of viewing shall be held responsible for any breakage or damage caused by him/her or young children in his/her care, and may be asked to pay for any item or items broken or damaged.

PAYMENTS: The auctioneer prefers payment by bank transfer for online purchases, however we do accept debit, credit cards and cash. Traveller’s cheques must be accompanied by a current passport. Personal cheques are accept only at the auctioneers discretion and must be supported by a valid bankcard, and only one cheque will be accepted in regard to any one transaction. Multiples of cheques are not acceptable. Company cheques or personal cheques for larger amounts can only be accepted by prior arrangement with the Auctioneers. 

CLEARANCE OF PURCHASES: ALL LOTS MUST BE PAID FOR AND REMOVED AT THE BUYER'S RISK AND EXPENSE BY 5.30pm ON THE SECOND WORKING DAY FOLLOWING THE SALE. AUCTION CAN HOLD PAID PURCHASES FOR POSTAGE/ COLLECTION FOR ONLINE/ OVERSEAS BUYERS. ***WE DO NOT TAKE PAYMENTS AUTOMATICALLY VIA THE SALEROOM***All Lots not collected shall remain at the buyer's risk, and may be subject to a mini¬mum warehousing charge of £2.50 per Lot per day. After 7 days the Auctioneers may re-sell the Lot or Lots by auction or privately, without notice to the buyer, to defray any costs incurred. The Auctioneers disclaim all responsibility for loss, damage or unauthorized removal of uncollected goods. IF THE AUCTIONEER HAS NOT HAD AN COMMUNICATION WITH TWO DAYS FOLLOWING THE SALE, ITEMS WILL BE REOFFERED TO THE NEXT SALE, AND THE SALEROOM WILL BE INFORMED, THIS MAY RESULT IN YOUR ACCOUNT BEING SUSPENDED.

GOLD & SILVER: The Auctioneers do not accept any responsibility for the authenticity or purity of any items not bearing British or Irish hallmarks.

ELECTRICAL ITEMS: The Auctioneers cannot make any guarantees as to the condition or safety of any Lots wired for electricity. It is recommended that buyers have these items examined by a qualified electrical contractor before use.

COMMISSION BIDS: The Auctioneers will be pleased to accept commissions in writing from intending purchasers unable to attend the sale. Printed forms are available for this purpose and must be completed clearly and in full, and if this is not done the Auctioneers reserve the right not to execute the bid or bids. This service is free to prospective buyers and the Auctioneers cannot accept liability for failure to make a commission bid. Instructions given by telephone, in writing or via the Internet are accepted at the buyer's risk and acknowledge acceptance of the Conditions of Sale. Internet bids must be received before the commencement of the sale.

* If there is more than one commission bid on any particular Lot for an identical amount, and these prove to be the highest bids, the Lot will be sold to the person whose bid was received first.

AGENCY: The Auctioneers act as agents only and they disclaim responsibility for either buyer or seller.

INDEMNITY: The buyer shall indemnify the Auctioneer against any claims in respect of any goods sold by them on the vendor's behalf.

THIRD PARTY LIABILITY: Every person on the Auctioneer's premises at any time shall be deemed to be there at his/her own risk and with notice of the condition of the premises and the method of arranging the furniture, etc. He/she shall have no claim against the Auctioneers in respect of any injury sustained or any accident, which may occur.

Online Bidding NL AUCTION ROOMS offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale. In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with NL AUCTION ROOMS you: 1. authorise NL AUCTION ROOMS, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and 2. confirm that you are authorised to provide these credit card details to NL AUCTION ROOMS through www.the-saleroom.com and agree that NL AUCTION ROOMS are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale. Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price Lots purchased online with the-saleroom.com will attract an additional charge for this service in the sum of 3% of the hammer price plus VAT at the rate imposed
