Terms & Conditions For Bidding

By submitting your bid, you agree that:

• You have read and agree with the Auctioneer Terms and Conditions & Privacy Policy below and the Sales-Room Terms of Use Agreement

• You agree to pay a buyer's premium of up to 25% and any applicable taxes and shipping.

High End Memorabilia - Condition of Sale

Winners will be notified after the auction ends and once all bids have been processed to determine the winner for each lot

As used herein the term "bid price" means the price at which a lot is knocked down to the purchaser and the term "purchase price" means the aggregate of

(a) the bid price,

(b) A PREMIUM PAYABLE BY THE PURCHASER OF 25%

(c) California state or local sales tax.

(d) Shipping & Handling cost

 Placing a bid is a legally binding obligation. There are no returns or exchanges. HEM is not responsible for any errors or omissions in the description, graphics or photography provided or in the bidding software. Due diligence to verify the condition and description of a lot is the sole responsibility of the Bidder prior to placing any bid. Returns may only be made with the advance written authorization of HEM and are in HEM's sole discretion to approve. To request a return you must provide a written request fully explaining the basis for the return no later than 3 days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking charge of 30% of the full invoice amount may apply in HEM 's sole discretion. Any allowed returns must be received in exactly the same condition as when originally shipped to Buyer, or they will be returned to buyer at Buyer's cost. Any unauthorized returns will be refused. DELIVERY REFUSAL OF ITEMS SHIPPED BY HIGH END MEMORABILIA TO THE BIDDER CONSTITUTES AN UNAUTHORIZED RETURN IN DIRECT VIOLATION OF THESE GENERAL TERMS AND CONDITIONS. WE RESERVE THE RIGHT TO ACCEPT OR DENY ANY BID PLACED EITHER IN INVALUABLE.COM OR AUCTIONZIP.COM. IF YOU DO NOT AGREE WITH THIS TERMS, PLEASE DO NOT BID.

If your item is not paid for in full after 4 days we reserve the right to charge that card on file.

Disputes/Chargebacks

By participating in High End Memorabilia's Auction, the bidder entirely agrees to the dispute resolution specified in the foregoing paragraph as the bidder's SOLE means to resolve any and all disputes which may arise with HEM. By placing a bid the bidder specifically agrees that bidder will not file a dispute or chargeback of any kind with an online venue, a credit card, or any other third-parties. Bidder specifically waives the right to initiate a credit card chargeback dispute on any basis of claim and agrees that bidder will pay HEM a minimum of $300 plus hourly charges and costs for any such chargeback dispute opened, due to the severe administrative burden of such disputes and their direct violation of the dispute provisions above. Upon breach of this agreement bidder grants full permission for HEM to charge their credit card once more to protect against bidders keeping items and filing a chargeback. In the event that Bidder violates this dispute resolution provisions, in consideration of HEM's approval of the application of the bidder to bid in HEM's auction, bidder confesses judgment to fraud having been committed by bidder against HEM and further agrees that bidder is liable to HEM for all damages, losses and costs.

A Buyer's premium amounting to 25% of the winning bid amount will be added to the purchase price of each lot. The winning bidders acknowledge and agree to pay a total of 25% premium on top of the winning bid price. Should the bidder choose not to go forward with the purchase, or cancel their item/s; they are still liable for the 25% premium as a penalty and an additional 25% Restocking fee.

Signatures & Authenticity Guarantee:

All autographed items come with a Lifetime Certificate of Authenticity with numbered tamper-proof decal. Actual signatures and location on items may vary slightly from picture.

This Certification of Authenticity does not imply that the item will be certified by any other rival authentication companies.  The accompanied certification is the only certification the auction company can confirm. These items are being sold as collectable pieces and there is no guarantee that this item can be resold on any online marketplace. Each of these companies has their own policies and politics.

BINDING AGREEMENT:

BY SIGNING UP AS A BIDDER, YOU ACKNOWLEDGED THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AUCTION HOUSE AND DO AGREE TO ABIDE BY THEM. 

PAYMENT IS EXPECTED AND ALL ACCOUNTS MUST BE SETTLED WITHIN 48 HOURS.

THE WINNING BIDDER OF ANY LIVE AUCTION HAS HEREBY ENTERED INTO A BINDING AGREEMENT, AS THE BUYER, TO PURCHASE THE AUCTIONED ITEM. BUYER IS FINANCIALLY RESPONSIBLE FOR THE IMMEDIATE PAYMENT OF THE PURCHASE. WINNING BIDDER IS DETERMINED SOLELY THROUGH INVOICING FOLLOWING THE COMPLETION OF THE AUCTION. 

AN INVOICE WAS SENT TO YOU THE NIGHT OF THE AUCTION.

IN THE EVENT OF NON PAYMENT OF THE PURCHASED ITEM THE BUYER IS RESPONSIBLE FOR ANY AND ALL COLLECTION AND LEGAL FEES IN ADDITION TO THE FULL PURCHASE PRICE OF THE ITEM. 

BUYERS THAT ARE SENT TO COLLECTIONS MUST PAY THE COLLECTION AGENCY DIRECTLY; AUCTION HOUSE WILL NOT ACCEPT ANY PAYMENTS AFTER INVOICE HAS BEEN FORWARDED TO COLLECTIONS. 

IN THE EVENT THAT YOU REFUSE DELIVERY OF THE PACKAGE FOR THE COMPLETION OF YOUR ORDER, AT THE DISCRETION OF HIGH END MEMORABILIA YOU WILL BE LIABLE FOR THE 25% BUYER'S PREMIUM AND AN ADDITIONAL 25% RESTOCKING FEE BASED ON THE TOTAL HAMMER PRICE PAID.High and low estimates are provided solely for comparison purposes and for the auctioneers use only; customers should not use this figure as a true determination of value, or confuse an estimate with an appraisal. High End Memorabilia makes no warranties of any kind relating to them.

We reserve the right to accept or deny any bids before the auction, during the auction or after the auction has concluded. In an event of a system failure or internet shortage, the bidder acknowledge that the auction house is at not fault.

Lots may have reserves or minimum selling prices. This confidential figure is set by High End Memorabilia. High End Memorabilia will exercise all reserve bids. The record of sale kept by the auction house is final if any dispute arises. Digital recordings of the sale will be used for confirmation. 

Bidder shall be responsible for all costs of collection, including court costs and reasonable attorney's fees. By participating in High End Memorabilia through the internet, bidders consent to the jurisdiction of the Courts where the auctions are held. 

IN THE EVENT THAT YOU REFUSE DELIVERY OF THE PACKAGE FOR THE COMPLETION OF YOUR ORDER, YOU WILL BE LIABLE FOR THE 25% BUYER'S PREMIUM AND AN ADDITIONAL 25% RESTOCKING FEE BASED ON THE TOTAL HAMMER PRICE PAID.

WE RESERVE THE RIGHT TO ACCEPT OR DENY ANY BID PLACED EITHER IN THE-SALEROOM.COM. LOTS MAY HAVE RESERVE. HIGH END MEMORABILIA WILL BID AGAINST THE RESERVE. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT BID.
