Actual viewing of the lots may be possible but only by prior arrangement with the auctioneers and in accordance with all current covoid-19 guidelines.

 

Auction Duration

Lots will be sold in numerical order (unless otherwise stated) at a likely rate of between 60 and 100 lots per hour.

Imperfections

The condition of pieces (other than where a number are included in the same lot) is mentioned in the catalogue and is intended as a guide to assist potential Purchasers. It remains the responsibility of the Purchaser to satisfy themselves as to the condition of each piece in any lot.

 

Registration

Those participating in the auction must provide acceptable identification consistent with current money laundering legislation.

 

Absentee Bidding

Commission Bids may be submitted by post or email to the Auctioneer who will execute such bids without obligation.  At the sole discretion of the Auctioneer bidding may also be undertaken by telephone.  Live internet bidding may be undertaken at either

Successful absentee bidders will be notified of their purchase(s) by telephone, email or post.

 

Buyers Premium

As a percentage of the hammer price on each lot:  24.00% (including VAT).

 

Live Internet Bidding Surcharge

www.the-saleroom.com a surcharge of 6.00% (including vat).

www.easyliveauction.com a surcharge of 3.60% (including vat).  Those bidders who take advantage of their pre-paid £3.00 fixed charge will not incur a surcharge.

 

Value Added Tax

Very occasionally a lot might additionally attract VAT on the hammer price at either 20.00% (if it is being sold by a person registered for VAT) or 5.00% (if it has been imported from outside the EU). In such case this will be noted in the catalogue.

 

Artist Resale Right

Payable in addition to the hammer price where noted in the auction catalogue.

 

Payment

Accounts may be settled by cash (maximum equivalent of 10,000 Euros), Sterling Cheque (clients known to Historical & Collectable) or bank transfer. 

Debit and Credit cards are NOT accepted.

Terms and Conditions of Business

Andrew Hilton trading as Historical & Collectable hereinafter referred to as the Auctioneer and to include any person acting upon his authority.

Conditions of sale - General

Catalogue:  All descriptions, whether printed, on our website or oral, are statements of opinion not fact. Intending Purchasers should satisfy themselves as to the condition, age and authenticity etc. of all lots.

Auction:  The Auctioneer reserves the right to accept or refuse any bid(s), regulate the bidding and amounts of any bid(s), rearrange, consolidate or withdraw any lot(s) or part of any lot without reason or notice. In the event of a dispute the Auctioneer has absolute discretion to settle such dispute.  All transactions associated with this auction sale shall be governed by English law.

Conditions of sale - Vendors

Indemnity:  The Vendor indemnifies the Auctioneer and his staff who act solely as agent for the Vendor.

Title:  The Vendor warrants to the Auctioneer and the Purchaser that they are the absolute owner of any lot and is authorised to sell the same and pass marketable title free of any encumbrance or claim.

Instructions:  Lots are sold at the Auctioneer’s discretion unless written instructions to the contrary are received and acknowledged by the Auctioneer more than 24 hours prior to the auction.

Proceeds:  The Vendor authorises the Auctioneer to deduct all monies due to him from the auction proceeds. The Auctioneer shall not be liable for settlement of any lot(s) for which he is not in possession of cleared funds.

Conditions of sale - Purchasers

Acknowledgment:  In making a bid for any lot, whether in person or otherwise, all bidders acknowledge they have read, understand and abide by all these Conditions of Sale.

Title:  Responsibility for a purchased lot shall pass at the fall of the hammer, however legal title shall not pass until the Auctioneer is in possession of cleared funds in payment for that lot.

Payment and Clearance:  All lots must be paid for in full within 7 days following the conclusion of the auction except where agreed by the Auctioneer in writing. No lot(s) may be removed until cleared funds are to hand except where agreed by the Auctioneer. Any lot(s) not paid for will incur storage charges calculated at the sole discretion of the Auctioneer and interest at 3% over Lloyds Bank Base Rate.

Purchase Price:  The Buyer will pay to the Auctioneer the hammer price together with a Buyer’s Premium calculated at a rate of 24.00% (including VAT), additionally any Value Added Tax and or Artist's Resale Right on the hammer price where noted in either the printed or web auction catalogue. The Buyer will additionally pay any surcharge arising for the use of a third party’s internet bidding platform.

Registration:  Clients must produce acceptable identification which has to be consistent with current money laundering legislation.
