Terms & Conditions

Conditions of Sale

1. Cluny Auctions acts only as an agent for the seller

2. (a) The buyer shall be the highest bidder acceptable to Cluny Auctions and Cluny Auctions shall have absolute discretion to settle any dispute.

(b) Every bidder shall, if required by Cluny Auctions complete and sign a Registration Form and provide identification before making any bid at the auction.

3. (a) Any representation or statement by Cluny Auctions whether in a catalogue or other publication or in a condition report as to the authorship, origin, date, age, size, medium, attribution, genuineness, provenance, condition or estimated selling price of any Lot is a statement of opinion only. Any illustrations in the catalogue are solely for guidance and are not to be relied upon in terms of tone or colour or necessarily to reveal imperfections in any lot.

(b) in addition, many lots are of age or nature which preludes their being in pristine condition and some descriptions in the catalogue or given for guidance only and the absence of such a reference does not imply that a lot is free from defects nor does any reference to particular defects imply the absence of others.

(c) Buyers must satisfy themselves as to all matters referred to in (a) and (b) above by inspection or otherwise prior to the date of the auction. The attention of Buyers is also drawn to the explanation of cataloguing practice contained in the catalogue.

4. The buyers premium will be 15% plus vat @ 20% on the hammer price.

5. (a) Upon the sale of a lot, the buyer shall: unless he has already done so, give to Cluny auctions his name and address and, if so required by Cluny Auctions, his bank or other suitable references.

(b) The property in a lot shall not pass to the buyer until he has paid the purchase price in full.



6. (a) Subject to condition 5(b) above, no lot may be taken away during the auction, nor may any lot be taken away until the purchase price has been paid in full.

(b) The buyer shall remove at his expense any lot purchased by him within one week from the sale.

(c) The buyer shall be responsible for any removal, storage and insurance charges on any lot not taken away within seven working days after the date of the auction.

7. A purchased lot shall be at the buyer’s risk in all aspects from the time of collection or the expiry of one week from the date of sale, whichever is the sooner, and neither Cluny Auctions nor it’s employees nor agents shall thereafter be liable for any loss or damage of any kind whether caused by negligence or otherwise, while any lot is in or under their respective custody or control.

8. If a buyer fails either to pay for or to take away any lot, Cluny Auctions shall, without further notice to the buyer and at its absolute discretion and without prejudice to any other rights or remedies it may have, be entitled to exercise one or more of the following rights or remedies.

(a) To issue proceedings against the buyer for damages for breach of contract together with the costs of such proceedings on a full indemnity basis.

(b) To rescind the sale of that or any other lots sold to the buyer at the same or any other auction.

9. Subject to the obligation accepted by Cluny Auctions under this condition, none of the seller, Cluny Auctions, its employees or agents is responsible for the correctness of any statement as to the authorship, origin, date, size, medium, attribution, genuineness or provenance of any lot, for any other errors of description or for any faults or defects in any lot and no warranty whatsoever is given by the seller, Cluny Auctions, its employees or agents in respect of any lot and any expense or implied condition or warranties are hereby excluded.

10. (a) Prospective buyers are advised to attend at the auction. Cluny Auctions will however, if so instructed, execute bids provided in writing in advance of the auction or bids by telephone (at Cluny Auctions) discretion) on their behalf, but neither Cluny Auctions nor its employees nor agents shall be liable to either the buyer or the seller for any neglect or default in so doing or for failure to do so

(b) In the event that Cluny Auctions has received commission bids on a lot for identical amounts and at auction those commission bids are the highest bids for that lot, the lot shall be knocked down to the person whose commission bid (for the relevant amount) was first received.

11. The Auctioneers can arrange for the collection of property for sale. The property will be covered by insurance for loss or damage during transit and while it is on their premises unless instructed in writing by the vendor not to do so. Damage to picture frames and glass is not covered by insurance. This will be based on the Hammer Price, the Reserve price, or at a figure deemed reasonable by a member of the Auctioneers Valuation Department.

12. A reserve price shall be placed on a lot on the written instructions of the vendor. No reserve will be accepted on a lot under the value of Fifty Pounds. In the event of a lot failing to reach a reserve price the Auctioneers will levy a charge of not less than five per cent of the reserve price. In the event of a reserve price not being reached at Auction, the Auctioneers reserve the right to sell the lot by private treaty at a price not less than the reserve price.

13. In the event that property offered at auction is not sold at auction, or is withdrawn before auction, the owner of such property shall within seven days after the auction in question or such withdrawal give instructions to the Auctioneers regarding the disposal of such property. In the absence of instructions the auctioneers shall be entitled to dispose of the property at their own discretion without giving notice to the vendor. A charge or levy will apply to goods withdrawn from auction at short notice.

14. Online Bidding

Cluny Auctions offer an online bidding service via the-saleroom .com for bidders who cannot attend the sale.

In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Cluny Auctions you:

(a) authorise Cluny Auctions, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and

(b) confirm that you are authorised to provide these credit card details to Cluny Auctions through www.the-saleroom.com and agree that Cluny Auctions are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.

Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price

16. Please ask for a condition report on any item at least 1 day before the sale date.
