AUCTION TERMS
1. By taking part in the auction, all bidders agree to be bound by these Auction Terms. In these Auction Terms AWGB Trading Ltd act only as auctioneers and agents for the respective vendors, and the representative of AWGB Trading Ltd conducting the sale is called “the Auctioneer". Unless the context requires otherwise, every reference to AWGB Trading Ltd includes the Auctioneer.
Arrangements for the auction, and bidding
2. The Auctioneer will be pleased to execute bids free of charge for anyone unable to attend the sale on receipt of written instructions, which may be submitted in either of the following ways:
(a) through www.the-saleroom.com , to be received by the Auctioneer by 6.00pm on the day of sale. Bids submitted after this time cannot be entered for the sale.
(b) by email to the Auctioneer care of treasurer@awgb.co.uk to be received by 4.00pm on the day of the sale. Any bids received after this time will only be accepted for the sale at the discretion of the Auctioneer.
AWGB Trading Ltd accepts no responsibility for the loss or non-execution of any bid submitted under (a) or (b)
3. Bids cannot be made by telephone.
4. Bidders attending the sale must register their details, and obtain a bidding number (paddle) before entering the auction room to view or bid.
5. Online Bidding
For this auction AWGB Trading Ltd are offering an online bidding service via www.the-saleroom.com for bidders not attending the sale. AWGB Trading Ltd accept no responsibility for the acts or omissions of www.the-saleroom.com . By kind agreement of the Auctioneer there will be no additional charge to successful bidders for lots purchased through www.the-saleroom.com
By completing the bidder registration on www.the-saleroom.com and providing your credit card details, and unless alternative arrangements are agreed with AWGB Trading Ltd. you:
(a) authorise AWGB Trading Ltd. if they so wish, to charge the credit card given in part or full payment, including all postage and delivery charges for items successfully purchased in the auction via www.the-saleroom.com , and
(b) confirm that you are authorised to provide these credit card details to AWGB Trading Ltd through www.the-saleroom.com and agree that AWGB Trading Ltd are entitled in fulfilment of the sale to ship the goods to the card holder name and card holder address provided.
Capacity of AWGB Trading Ltd and the Auctioneer
6. For all purposes of sale AWGB Trading Ltd and the Auctioneer shall be deemed to be the agents of both the vendor and purchaser. The Auctioneer may in the case of lots upon which there is a reserve price exercise the right to bid on behalf of the vendor. As agents AWGB Trading Ltd and the Auctioneer are not responsible for any default by either the vendor or purchaser.
Descriptions
7. All reasonable efforts are made to describe lots as fairly and as accurately as possible. Descriptions are believed to be correct but are given as an expression of opinion only, and the lots are sold subject to all faults and errors in description. AWGB Trading Ltd will not be responsible for the correctness of the description of any item, including measurement, weight, date, age, composition, authenticity, condition or faults of any item.
Estimates
8. Pre-sale estimates are intended only as a guide for prospective purchasers. Depending on the degree of competition, lots can realise more or sometimes less than the listed estimates. Estimates are subject to revision.
Disputes
9. If any dispute or disagreement arises between two or more bidders, or between AWGB Trading Ltd. and any person taking part in the auction, the Auctioneer has absolute discretion to settle it as he thinks fit or to re-offer or withdraw the lot.
Undisclosed third parties
10. Any bidder acting on behalf of a disclosed or undisclosed third party will be jointly and severally liable with that third party for satisfaction of all arising obligations and liabilities. This does not apply to the Auctioneer where he is acting on behalf of commission or other bidders.
Payment
11. (a) No buyer’s premium or VAT will be charged to successful bidders on the price of the lot
(b) Bidders in the room should settle their account with the AWGB Treasurer, David Atkinson, immediately after the auction, or, by arrangement, no later than noon on Saturday, 10 August 2013. You will receive a sales receipt with your lot.
(c) Online Bidders: The Treasurer will issue an invoice by email to successful online bidders no later than noon (UK Time) on Saturday 10 August.
(d) Payment must be made (and cleared) before noon on Sunday, 11 August 2013 (see 12 below).
(e) Lots cannot be paid for by charity cheque or vouchers, nor does Gift Aid apply to the purchase price.
(f) AWGB Trading can accept payment by

Collection or despatch of lots
12. No lot may be collected, and no lot will be despatched, unless payment has been made in full. Lots may be collected in person before the end of the Seminar on Sunday 11th August. Any lot not paid for and collected by that time will (subject to payment) be despatched to the purchaser of the lot by AWGB Trading Ltd at the cost and risk of the purchaser. The purchaser of any lot agrees to pay AWGB Trading Ltd all costs relating to packing and despatch of the lot, which will attract Value Added Tax charged at the prevailing rate (currently 20%)
