Terms & Conditions

CONDITIONS OF SALE

  1. The highest bidder to be the purchaser; if any dispute shall arise between two or more bidders, the lot in dispute shall be resold.
  2. The bidding to be under the direction of the auctioneer, who shall reject any bidding of which he may disapprove.
  3. The purchaser to declare their name and addresses and pay to the Auctioneer or his Clerk such a deposit as may be required in part payment immediately on the fall of the hammer, or the whole of the amount due, if then demanded, and the whole of the purchase money to be paid and cleared, before the delivery of the lots, if less than the full amount be due upon his or her purchases shall be deemed to be a deposit account of the whole.
  4. The lots to be taken away and paid for whether genuine or not, with all faults and errors of description, at buyer’s risk and expense, at the close of the sale. The auctioneer not being responsible for the incorrect description, genuineness, or authenticity of, or any fault or defect in any lot and making no warranty whatsoever. DEFAULT. Andrew Hilditch and Son Ltd. disclaim responsibility for the default by either the buyer or the vendor because they act as auctioneer only and therefore do not pay out to the vendor until payment is received from the buyer. instructions given by telephone or internet are accepted at the sender’s risk and must be confirmed in writing forthwith. All internet enquiries and bids must be received by 9:00 am on the day preceding the auction date to allow time for processing procedure. Final instructions to be received by telephone or fax by 10:00am on the day of the sale.
  5. Upon failure in complying with the above condition the deposit money shall be forfeited, and the Auctioneer or Vendor shall have the option of re-selling the uncleared lots, either by public or private sale, without notice, and the deficiency (if any) and all expenses attendant thereon shall be made good by the defaulter in this auction.
  6. The Auctioneer reserves the right to withdraw, consolidate, subdivide or alter the order of the sale if he thinks fit to do so, and bid for the vendor where there is a reserve on any lot or lots.
  7. Third Party Liability. Every person in the Auctioneer’s premises at any time shall be deemed to be there at his own risk and with notice of the condition of the premises and the method of arranging furniture etc. He shall have no claim against the Auctioneer in respect of any injury he may sustain, any accident that may occur.
  8. At the fall of the hammer a premium of 20% including VAT is payable by the buyer to Messrs. Andrew Hilditch & Son Ltd. for their own retention and will not be waived.
  9. Andrew Hilditch & Son Ltd. reserve the right at their discretion to refuse admission to their premises or attendance at their sales.
  10. By the making of any bid the buyer acknowledges his acceptance of these conditions and the terms of any notices in the auction room.
  11. Vandals of restored work will be prosecuted.
  12. Debit cards are accepted at no extra charge. Payment by credit card will attract an extra 2% on the total bill. Cheques are not accepted.
  13. Lots which have not been removed and paid for within ten days following the auction will attract a rent charge of £1 plus VAT at the standard rate per lot per day (unless previously negotiated with the Auctioneer).
  14. All mechanical items in the auction are sold without warranty, but remain in the condition viewed. Condition reports may not be relied upon as confirmation of the chattel in working order. The prospective purchasers must satisfy themselves as to the working condition of the chattel.

‘Artists Resale Rights’. Items marked (AR) are subject to 4% copyright fee if the Lot exceeds the equivalent of 1000 Euros on the day of sale.
