Artist's Resale Right Scheme (Droit de Suite)
Following the UK’s implementation of the EU Artist’s Resale Right directive in 2006, living artists, and with effect from 1st January 2012 artists deceased within the past 70 years, are entitled to receive a resale royalty each time their art work is sold in the UK by an art market professional, subject to certain conditions. This payment is calculated on qualifying works of art which are sold for a hammer price or best bid price of more than EUR 1000. The UK sterling equivalent of EUR 1000 will fluctuate in line with prevailing exchange rates.
The actual qualifying threshold will be calculated by the Artist’s Resale Right Service Hub based on the European Central Bank reference rate published at 2.15pm on the day of the sale, and can be found on www.dacs.org.uk.
The royalty charge will apply if the hammer price is more than the UK sterling equivalent of EUR 1000. The royalty charge will normally be added to buyer invoices and must be paid before items can be cleared. Some auctioneers may choose to split the charge between the buyer and the vendor. Some auctioneers may pass the entire charge to the vendor. Before bidding, we advise that you check which scheme your auctioneer's are operating. All royalty charges are paid to the Design and Artists Copyright Society (“DACS”) and no handling costs or additional fees with respect to these charges are retained by auctioneers.
Artist's Resale Right is a percentage of the hammer price calculated as follows:
Portion of the hammer price (Euro’s EUR)
1000 to 50,000
50,000.01 to 200,000
200,000.01 to 350,000
350,000.01 to 500,000
VAT is not payable on this royalty charge. The maximum royalty charge is 12,500 EUR.
Buyer Terms and Conditions
INFORMATION FOR BUYERS
The following informative notes are intended to assist buyers, particularly those inexperienced or new to our salerooms. Our staff will be happy to advise you if there is anything you do not fully understand.
The auctioneers are unable to pack and dispatch purchases, unless by prior arrangement before the sale. We recommend Mail Boxes Etc. Tel: (01752) 257224, email@example.com and The Auction Postal Service, Tel: 07736 544362, firstname.lastname@example.org
As auctioneers we usually contract as agents for the seller whose identity, for reasons of confidentiality, is not normally disclosed. Accordingly if you buy, your primary contract is with the seller.
Estimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. Any reserve price will not be higher than the bottom estimate. Estimates do not include the Buyer’s Premium or VAT. Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive.
The Conditions of Sale oblige buyers to pay a buyer’s premium at 20% + VAT on the hammer price of each lot purchased. For selected sales we do offer an additional online ‘live bidding’ service; buyers using this facility will be subject to an additional premium plus VAT.
Condition of Lots
We are, primarily, agents for the seller. We are dependent on information provided by the seller and whilst we may inspect lots and act reasonably in taking a general view about them, we are normally unable to carry out a detailed, or any, examination of lots in order to ascertain their condition in the way in which it would be wise for a buyer to do. Intending buyers have ample opportunity for inspection of goods and, therefore, accept responsibility for inspecting and investigating lots in which they may be interested. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Neither the seller, nor we as the auctioneers, accepts any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order.
However, in so far as we have examined the goods and make a representation about their condition, we shall be liable for any defect which that examination ought to have revealed to the auctioneer but which would not have been revealed to the buyer had the buyer examined the goods. Additionally, in specified circumstances, lots misdescribed because they are ‘deliberate forgeries’ may be returned and repayment made. There is a 2 week time limit. (The expression ‘deliberate forgery’ is defined in our Conditions of Sale).
We may be able to assist buyers unable to view by posting, faxing or e-mailing a condition report. We provide the information for guidance only, without legal obligation or prejudice to our standard terms and conditions of sale. Eldreds Auctioneers & Valuers cannot be held responsible for damage or faults that may be missed during our inspection of the item(s) in question. You should not rely upon this report when deciding whether or not to make a bid. Condition reports do not include manufacturing defects that occurred during the production of the item. Please note that any attached illustrations are intended as a guide only. Colours and general appearance may differ from the original item(s). We strongly recommend that you inspect the lot yourself and consult an independent professional conservator or restorer. Condition reports cannot be prepared on day of sale. Please see our Conditions of Sale.
These are sold as ‘antiques’ only and if bought for use must be checked over for compliance with safety regulations by a qualified electrician first.
Export of Goods
Buyers intending to export goods should ascertain (a) whether an export licence is required and (b) whether there is any specific prohibition on importing goods of that character because, eg. they may contain prohibited materials such as ivory.
Commission Bids may be left with the auctioneers indicating the maximum amount to be bid excluding buyers’ premium. They will be executed as cheaply as possible having regard to the reserve (if any) and competing bids. If two buyers submit identical commission bids the auctioneers may prefer the first bid received. Please enquire in advance about our arrangements for the leaving of commission bids by telephone, fax or e-mail. All absentee bids should be received before the auction commences, we cannot guarantee to accurately execute bids received once the auction has commenced. All email bids must be received by no later than 9.30am on the morning of the sale.
The number of lines is limited so we would urge serious telephone bidding only and ask that you be prepared to bid over the top estimate.
It is advisable to leave a maximum covering bid in case we are not able to contact you by telephone.
All lines must be booked and confirmed in writing before the day of the auction and preferably some time in advance.
Telephone bidding involves many variables and whilst we take every care to ensure the smooth running of this service, we cannot be held liable if your bids are missed for any reason.
Eldreds Auctioneers & Valuers offers an online bidding service via the-saleroom.com and easyliveauction.com for bidders who cannot attend the sale. In completing the bidder registration and providing your credit/debit card details and unless alternative arrangements are agreed with Eldreds Auctioneers & Valuers, you:
a. authorise Eldreds Auctioneers & Valuers, if they so wish, to charge the credit/debit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
b. confirm that you are authorised to provide these credit/debit card details to Eldreds Auctioneers & Valuers through www.the-saleroom.com/easyliveauction.com and agree that Eldreds Auctioneers & Valuers are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
Please note that any lots purchased via online live auction services will be subject to an additional commission charge + VAT at the rate imposed on the hammer price. Artist’s Resale Right (“Droit de Suite”) ** indicates works which may be subject to the Droit de Suite or Artist’s Resale Right which took effect in the UK on 14th February 2006. We are required to collect a royalty payment for all qualifying works of art under new legislation which came into effect on 1st Jan 2012; this applies to living artists and artists who have died in the last 70 years. This royalty will be charged to the buyer on the hammer price and in addition to the buyer’s premium. It will not apply to works where the hammer price is less than €1,000 (euros). The charge for works of art sold at and above €1,000 (euros) and below €50,000 (euros) is 4%. For items selling above €50,000 (euros), charges are calculated on a sliding scale. All royalty charges are paid to the appropriate organisation and no handling costs or additional fees are retained by the auctioneer. Resale royalties are not subject to VAT. Please note that the royalty payment is calculated on the rate of exchange at the European Central Bank on the date of sale. More information on Droit de Suite is available at www.dacs.org.uk
All electrical goods offered in this sale have either been tested and cerftified by an appropriately qualified electrician or have been operationally disabled. We would strongly advise that any intended re-commissioning is undertaken by an appropriately qualified electrician.
Post 1950 Furniture
All items of furniture included in this sale are offered for sale as works of art. The items may not comply with the Furniture and Furnishings (Fire) Safety Regulations 1988 and for this reason, they should not be used in a private dwelling.

Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid so made.
11. Warranty of title and availability
The seller warrants to the auctioneer and you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims.

The seller acknowledges that Lots are sold subject to the stipulations of these Conditions in their entirety and on the Terms of Consignment as notified to the consignor at the time of the entry of the Lot.
(1) Subject to the next following Condition concerning deliberate forgeries, any representation or statement by us in any catalogue as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price is a statement of opinion only. Prospective buyers are given ample opportunities to view and inspect before any sale and prospective buyers must satisfy themselves as to all such matters. Neither the auctioneer nor its employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, express, implied or statutory are hereby excluded.
(2) Private treaty sales made under these Conditions are deemed to be sales by auction for purposes of consumer legislation.

If we are satisfied from the evidence presented that the Lot is a deliberate forgery we shall refund the money paid by you for the Lot including any buyer’s premium (but not the amount of any consequential loss, damages, expenses or interest) provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition.
16. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person.
17. Any indemnity or exclusion under these Conditions shall extend to all actions, costs, expenses, claims and demands whatsoever suffered or incurred by the person entitled to the benefit of it and the auctioneer declares itself to be a trustee of the benefit of every such clause so far as it is expressed to be for the benefit of its employees and agents.
