The lots are offered for sale on the DROUOT platform by MAC, which acts as an exclusive agent, in the name and on behalf of each Seller, The effects of the sale affect the seller and MAC does not assume towards the Assignee and third parties in kind other responsibility besides that deriving from the quality of agent. Neither Mac, nor its directors and employees will be responsible for acts or omissions relating to the preparation or conduct of the auction or for any matter relating to the sale of the work.

 

Mac does not issue certification relating to the gems sold, but offers already certified products at auction or with the indications provided by the proponents of the products to be auctioned. The various types of certification (GIA, IGI, AIG, SGL, and possibly others) are opinions of prestigious internationally recognized and authorized gemological institutes. MAC, as an intermediary, does not assume any responsibility for these assessments by the institutes issuing the certificates or for the information provided by the proposers of the products.

 

MAC reserves the right to extend the auction at the request of the contractor without prior notice.

 

2 .. AUCTION FEES

 

The successful bidder will pay MAC an auction commission for each lot specified in the single auction.

 

On the aforementioned commissions MAC will apply the margin regime.

 

In others, VAT is applied to lots delivered by Sellers subject to VAT who will be subject, in addition to the VAT calculated on the auction commission, also to VAT on the hammer price.

 

3.PARTICIPATION IN THE AUCTION

 

Before each Auction, all participants are required, for the validity of any award, to fill out a participation form from the DROUOT portal with their personal data. It should be noted that, in any case, MAC reserves the right not to accept offers.

 

4. DESCRIPTION OF THE LOTS

 

MAC acts as an agent of the Sellers and declines all responsibility for the description of the objects. After the award, neither MAC nor Sellers can be held responsible for defects relating to the state of conservation, for the incorrect attribution, authenticity, origin, weight or lack of quality of the objects. Neither MAC nor its staff will be able to issue any guarantee to this effect, except in the cases provided for by law. The consumer is informed about the rights he owns pursuant to art. 130 of the Consumer Code (in particular with regard to the consumer's right to restore, without charge, the conformity of the goods and the duration of the guarantee) that there is no lack of conformity if, at the time of purchase, the buyer was aware of the defect or could not ignore it with ordinary diligence.

 

5. PAYMENT OF THE PRICE

 

The total payment of the hammer price including charges may be immediately demanded by MAC, in any case it must be made in full, in Euros, within four days of the award. The payment and collection of the lots must be made as specified on the proforma invoice page sent at the end of the auction. Failing MAC, without prejudice to compensation for greater damages, may:

 

proceed with the compulsory execution of the obligations arising from the purchase;

dispose of the lot by private negotiation or in a subsequent Auction to the detriment of the Awardee, withholding any advances received as a penalty.

The object will be kept by MAC at the risk and expense of the Successful bidder until it is sold as above or returned to the Seller at the request of the same. In any case, up to the date of return or sale, the successful bidder will be required to pay MAC a penalty equal to the interest, calculated on the hammer price plus auction fees, at the interbank rate in force plus two points; the interest thus calculated will be applied to the amounts due from the eighth day following the date of the award.

 

6. COLLECTION OF LOTS

 

The successful bidder, having paid the hammer price and the auction fees, will have to collect the purchased lots at their own risk and expense no earlier than 5 working days from payment. After this deadline, MAC will be exonerated from any responsibility towards the successful bidder in relation to the custody, any deterioration of the objects and will have the right to transfer the uncollected lots at the expense and risk of the purchaser to its offices or public warehouses or private. Upon express request, MAC may organize the transport and insurance of the lot at the expense and risk of the successful bidder.

 

7.DEROGHE

 

Notwithstanding any provision to the contrary contained herein, MAC reserves the right to agree with the successful bidders special forms of payment, to deposit in public / private warehouse or privately sell the lots awarded and not withdrawn, to insure the lots awarded, to resolve disputes and disputes. carried out by or against the successful bidders and in general to undertake any action deemed appropriate in order to collect sums due from the successful bidder and also, depending on the circumstances, to cancel the sale.

 

8 BATCH INFORMATION

9. ANY THIRD PARTY CLAIMS ON THE LOTS

 

In addition to any other obligation or right provided for in these Conditions of Sale, MAC in the event that it has been informed or becomes aware of any claim or right of third parties relating to the ownership, possession or possession of the Lot may, at its discretion , hold the Lot in custody pending settlement of the dispute or for the entire period reasonably deemed necessary for such settlement.

 

10. ANTI-MONEY LAUNDERING

 

The customer acknowledges and accepts, pursuant to and for the purposes of art. 22 Legislative Decree n. (Anti-Money Laundering Decree), to provide all the necessary and updated information to allow MAC to fulfill its customer due diligence obligations. It is understood that the completion of the transaction is subject to the release by the Customer of the information requested by MAC for the fulfillment of the aforementioned obligations.

 

Pursuant to art. 42 Legislative Decree n. 231/07, MAC reserves the right to refrain and not conclude the transaction in the event of it being objectively impossible to carry out customer due diligence.

 

11. APPLICABLE LAW

 

This contract is regulated by the Italian law.

 

12. DISPUTES

 

These Conditions of Sale are automatically accepted by those who compete for the Auction and are available to any interested party who requests them. The jurisdiction of the Court of FERRARA is established for any possible controversy. It should be noted that the clause of derogation from the consumer's forum has been the subject of specific individual negotiations and the contractor declares to accept its content.
