TERMS OF SALE BY AUCTION AND CONDITIONS OF BUSINESS
Mainly Concerning Buyers
CONDITIONS OF SALE
1. A buyers commission of 18% + VAT (VAT is charged on the 18% commission only). The VAT rate may alter and will be levied at the appropriate rate. Any lots marked with an asterisk(*) will be subject to VAT on the hammer price.
2. The seller can place a reserve on any lot and the auctioneer shall have the right to bid on behalf of the seller. A 4% surcharge will be added to any credit card transactions and £1 will be added for debit cards
3. The highest bidder shall be the purchaser and no person shall retract a bid and should any dispute arise between any two or more bidders, the lot in dispute shall be offered again or not at the discretion of the auctioneer who is to be the sole arbitrator of any matters of dispute during the sale. The vendors reserve the right to bid.
4. Commission Bids: Any person unable to attend the auction may request the auctioneer to bid on his/her behalf. This service is free of charge, bidding forms will be available. These should be handed in at the Auction Office. Commission bidders are urged to ascertain whether they have been successful or not on the day of the sale or on the Monday following the sale. Lots will be purchased by the auctioneer on behalf of the commission bidders as cheaply as is allowed by other bids and/or reserves prices if any. Buy bids will not be accepted by the auctioneers. The auctioneers cannot accept responsibility for any neglect or default in executing or failing to execute commission bids.
5. All buyers are deemed to have read and understood our methods of payment, as outlined in the catalogue. All buyers accounts are to be settled within 24 hours.
6. No bidder shall advance less than a sum to be named by the auctioneer and he has the right to refuse any bid.
7. The auctioneer will not release goods to clients until cheques have been cleared. A period of five working days will be needed to clear cheques. Purchasers will be held liable for any expenses arising from their method of payment. Lots may be claimed and cleared after the conclusion of the sale. Lots will be released only on production of a release slip receipted by the Accounts Department. Ownership of a lot purchased shall not pass to the buyer until full payment has been made to the Auctioneer of the total amount due.
8. Free storage of all lots will be provided for three working days following the sale, thereafter a storage and handling charge of £5.00 plus VAT per lot per day will be levied.
9. The purchaser shall give their name and address and may be required to pay a deposit of 25 pence in the pound in part payment, or the whole of the purchase money. The deposit paid by the purchaser on any lot shall be reckoned as a deposit on each and all of the lots booked in his or her name. The purchaser must not share his/her registration number with any other person/s; ie one invoice per customer.
10. All lots sold with any faults and errors of description are neither the vendor nor the Auctioneer’s responsibility for the authentically, provenance attribution of ownership, date, age, condition or quality of any lot. All statements in the catalogue as to any such matters are statements of opinions and not to be relied upon as statements or representation of fact. Intending purchasers must satisfy themselves by inspection or otherwise to all such matters and to the physical description of any lot. Plaistow Auctions will accept no claims for loss or damage thereafter. No compensation shall be paid.
11. All lots must be taken and cleared away at the purchasers expense between the hours of 9.30 am – 5.00 pm on the day following the sale.
12. The Auctioneer reserves the right to refuse any bidding or to withdraw any lots from the sale.
13. Only small items purchased can be removed during the sale.
14. If any lot or lots are unsold, they must be removed from the sale room by the owner, as the Auctioneers accept no responsibility whatsoever for goods after seven days from the date of the auction sale.
15. Vendors who do not collect their goods are advised that the goods will be placed into the following auction without a reserve price.
16. Upon failure of compliance with the above conditions, or any of the purchasers neglecting or refusing to clear away his or her lot, any deposit money shall be forfeited and the lots that remain un-cleared after the time limited shall be re-sold by public or private sale and the deficiency (if any) by such second sale, together with all the charges attending the same, whether or not a deposit has been paid. Any surplus shall be retained by the auctioneers. The condition is without prejudice to the right of the auctioneer to enforce the contract made at this sale, without such re-sale if he thinks fit.
17. NO CHILDREN UNDER THE AGE OF 16 YEARS ARE ADMITTED TO THE SALE ROOM

Plaistow Auctions offers an online bidding service via the-saleroom.com for bidders who cannot attend the sale.
In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Plaistow Auctions:
a. authorise Plaistow Auctions, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
b. confirm that you are authorised to provide these credit card details to Plaistow Auctions through www.the-saleroom.com and agree that Plaistow Auctions are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
