Terms and Conditions
1. CATALOGUING
Whilst Lawrences make every effort to ensure accuracy in the cataloguing of lots offered for sale, each lot is offered for sale by the vendor with any imperfections or errors of descriptions.
Lawrences do not accept responsibility as to the authenticity, date, age, period, provenance, attribution or condition of any lot. All statements either printed in the catalogue or made orally regarding the above are statements of opinion only and are not to be taken as implying any warranties or representations of fact by Lawrences.
2. THE AUCTION
The Auctioneer has absolute discretion to divide any lot, to combine any two or more lots or to withdraw any lot from the sale, to refuse bids, regulate bidding or cancel the sale without giving any reason or without prior notice. He may bid on behalf of the vendor for all goods which are being offered, subject to reserve or at the Auctioneers discretion.
The highest bidder shall be the buyer except in the case of a dispute. If during the auction the Auctioneer considers that a dispute has arisen, he has absolute discretion to settle it or to re-offer the lot.
Each lot is offered for sale subj ect to any reserve price placed by the vendor.
Notwithstanding any other terms of these conditions, if within 21 days after the sale the Buyer of any lot returns the same to Lawrences in the same condition as at the time of sale and satisfies Lawrences that considered in the light of entry in the catalogue the lot is a deliberate forgery, the sale of the lot will be rescinded and the purchase price of the same refunded in full. In event of a dispute then the matter shall be settled by arbitration, the arbitrator to be nominated by the President of the Royal Institution of Chartered Surveyors. Both the buyer and the vendor agree to be bound by the decision.
c) Lawrences disclaim responsibility for default by either the buyer or vendor as they act as agents for the vendor only and therefore do not pay out to the vendor until payment is received from the buyer. All goods delivered to Lawrences are insured whilst on the premises, a 1% insurance charge will be deducted from all items once sold.
All goods are put up for sale without reserve at the auctioneers discretion unless written instructions as to reserves are received by Lawrences prior to the commencement of the sale.
Lawrences reserve the right to sell a lot within 10% of the given reserve price.
The vendor authorises the Auctioneers to deduct commission and expenses at the stated rates from the hammer price and acknowledges the Auctioneers right to retain any premium payable by the purchaser.
The vendor gives Lawrences absolute right to photograph and illustrate any lot placed in its hands for sales and to use such photographs and illustrations at any time with absolute discretion.
4. BUYERS CONDITIONS:
By making a bid for a lot, each buyer acknowledges that he has satisfied himself fully before bidding by inspection or otherwise as to the sale conditions, the physical condition of and description of the lot including but not restricted to whether the lot is damaged or has been repaired or restored.
Legal title shall not pass to the buyer until the lot/lots have been paid for in full, the auctioneer shall be entitled to hold the lots until payment has been made in full. Each lot is at the sole risk of the buyer from the fall of the hammer. Each buyer shall forthwith give his full name and permanent address, and if required to do so by the auctioneer, shall forthwith pay Lawrences such a proportion of the sale price that the auctioneer may require. If the buyer fails to do so, the lot may at the auctioneers discretion be put up for sale and re-sold.
Lots are to be taken away at the buyers expense and paid for within THREE DAYS from the sale. Upon failure of buyer to comply with these conditions the money deposited in part payment shall be forfeited and entirely at the discretion of the auctioneer the lot will be either put into storage at the expense of the buyer or re-sold by public or private sale, and the deficiency (if any) shall be made good by the said defaulting buyer.
