Terms & Conditions

Buying at auction

Catalogues will be available online about three weeks before the sale. The catalogue will provide information including the name of the lot, its material composition, size, date or age, provenance, quality and estimated price etc.

Viewing

All of our auctions are on view at least two days prior to the sale and details will be found in the relevant catalogues and for preview online. We would always recommend that you come to the saleroom and inspect the lot(s) you are interested in.

Condition Reports

We will be pleased to offer condition reports on any lot on request. The condition reports are used as a supplement to the catalogues and offer guidance on the lot to the best of our knowledge.
Please note: The colours printed in the catalogue may not necessarily be identical to those of the actual object.

Bidding at auction

Registering

All first time buyers need to register with us. Once registration is complete you will be provided with a permanent paddle number, which can be used in all future sales.

To register, you will need to provide two forms of identification:

1. a passport or photographic driving licence

2. a utility bill or acceptable document showing your name and address

You can register in person or by contacting the office on 07727607266 or by emailing register@dingtianuk.com or dengji@dingtianuk.com (Chinese language service). You will be asked to show your documents or to email copies of them.

Bidding in the Saleroom

You will need to have registered with us and obtained a paddle number, as described above.

Commission Bidding

If you are unable to attend the sale you can leave a commission bid. This will be executed on your behalf by the auctioneer who will purchase the lot as cheaply as possible bearing in mind any reserve price and other bids.

Telephone Bidding

It is usually possible to bid on the telephone by prior arrangement with the office. Registration is required as above.

Live Online Bidding

Live online bidding is now available for most of our auctions via the-saleroom.com, enabling you to take part in the bidding from anywhere in the world, live as it happens. To bid online you need to register at www.the-saleroom.com , subject to approval.

In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Ding Tian UK Auction Ltd, you:
1. authorise Ding Tian UK Auction Ltd, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
2. confirm that you are authorised to provide these credit card details to Ding Tian UK Auction Ltd through
www.the-saleroom.com and agree that Ding Tian UK Auction Ltd are entitled to permit the shipping of the goods to the card holder name and card holder address provided in fulfillment of the sale.

Please note: if you wish to bid online with us you need to bid through www.the-saleroom.com However, it is necessary to register with the-saleroom.com as well as with ourselves

Buyer's Premium

Each lot is subject to a Buyer's Premium of 22% + VAT on the first £50,000 of the hammer price, 18% of the excess of the hammer price above £50,000 up to and including £1,000,000 and 11% of any amount in excess of £1,000,000 + VAT thereafter.

VAT

Lots marked with an asterisk (*) are subject to VAT on the hammer price. Lots marked with an omega (O) have been temporarily imported from outside the EU and are subject to VAT at 5.0% on the hammer price. In online catalogues, the Sales Tax % column indicates the rate of VAT on the hammer price. This is in addition to the buyer’s premium.

Payment

Payment is due immediately after the auction in pounds sterling. If you are a first time buyer we will need your name, address and bank details and will require funds to be cleared before purchases can be released.

Payment may be made by the following methods:
banker’s draft, personal cheque, travellers cheques, debit and credit cards and cash only up to a sterling equivalent of £7,500.

PLEASE NOTE: Cheques usually take 5 – 7 working days to be cleared.

Where practical, payment can be made and purchases collected immediately after the auction (within 3 working days). Any lot unpaid after 3 working days will be charged interest at a rate of 1.5% per month on the total amount due to the extent it remains unpaid. Any uncollected lots will be removed and stored by our storage company.

Storage charges will be levied on all lots in sales not collected. This will include a handling fee of £20 (+ VAT) per consignment and a storage charge of £2 (+ VAT) per lot per week. No goods will be allowed to be collected until these charges have been paid.

These storage charges will be paid to Ding Tian UK auction.

Packing Delivery & Shipping

Packing and dispatch service are provided through our specialist art shipping company whether local or international, including storage, insurance, export license and other logistical details needed to finalise your purchase.

All the costs will be paid directly to our shipping company.

Sale Results

These will be posted on our website shortly after the sale.

Artist's Resale Right/Droit De Suite

Droit de Suite is a royalty payable to European Economic Area (EEA) living artists or the artist's estates, where the EEA artist died in the last 70 years, each time one of their works is resold.

Royalties are calculated on a sliding percentage scale based on the hammer price excluding the buyer's premium. The royalty does not apply to lots selling below the sterling equivalent of €1,000 and the maximum royalty payable on any single lot is the sterling equivalent of €12,500.

Droit de Suite, which is not subject to VAT, will be added to the buyer's purchase price and then passed on to the relevant collecting agency.

Please enquire for the accepted exchange rate on the day of the sale.

Royalties for Droit de Suite are as follows:
