Terms & Conditions



1 Britannia Piano Auctions Ltd are hereafter referred to as ‘the Company’.

2 For the purpose of these terms & conditions the Company functions as agents and auctioneers only.

3 The Company representative or representatives who conduct the auction will be referred to as auctioneers.

4 The auctioneer alone will hold responsibility for the control of bidding. Any decision to cancel bids, refuse bids, withdraw lots from sale, divide any lots or combine any lots will be that of the auctioneers.

5 The auctioneer has the authority to bid on behalf of the vendor for any lot subject to a reserve, otherwise the vendors may bid themselves.

6 Any information regarding any lot is subject to change by auctioneer’s announcement from the podium prior to bidding opening for that lot.

7 The buyer shall be the bidder who enters the highest bid that is accepted by the auctioneer.

8 A reserve will be the minimum price at which the lot may be sold.

9 The Company will do its best to ensure the accuracy of lot descriptions created by the Company in written or electronic format.

10 Where the Company provides a condition report, oral opinion, written or electronic set of details it cannot guarantee or offer any warranty on those contents.

11 All bidders will be deemed as having satisfied themselves about the condition and physical state of the lot and weather the lot has been damaged repaired or restored. This is to take place before any bids are entered.

12 Bids may only be entered once bidders have accepted the buyers terms and conditions.

13 Once the hammer has fallen on a sale the responsibility and risk of a lot rests with the buyer but the legal title will not pass to the buyer until the lot has been paid for in full.

14 Payment methods accepted are cash, cheque, debit card, credit card, bank transfer. All funds must be cleared before legal title will pass to the buyer after which the lot may be collected and removed at the buyer’s risk and expense.

15 The payment in full that must be cleared before the legal title will pass shall be the hammer price of the lot plus a premium of 19% of the hammer price plus VAT on the hammer price and premium if applicable.

16 Payment made by cheque must be payable to the company and be drawn from the buyers account from a UK bank or building society.

17 Payments made by debit card must be from accounts bearing the buyers name.

18 Payments made by MasterCard or Visa credit card will attract a surcharge of 3% plus VAT. Payments made by American Express credit card will attract a surcharge of 5% plus VAT.

19 Payments made be secure bank transfer must be cleared into the Company’s bank account with any costs of the transfer borne by the buyer.

20 Third party cheques will not be acceptable.

21 Payment in full is due by the end of the next working day after the sale. If the buyer fails to make payment by this time the Company has absolute discretion to:

21.1 charge interest at a rate of 10 percentage points above the Bank of England base rate in force at the time. The interest shall be payable on the total amount due to the company from the date of sale until all amounts including interest are paid to the company.

21.2 Resell the lot without giving notice to the buyer. Any shortfall from the previous sale price together with charges, expenses and interest will be recoverable from the buyer.

21.3 Hold a lien over the lot and any other good owned by the buyer that are in the companies possession at that time or later until the lot has been paid for in full by the buyer.

21.4 Charge and recover from the buyer any relevant transport costs and a storage fee of £2 per lot per day plus VAT

22 Where a lot is not paid for in full or collected by the buyer responsibility and risk for that lot will remain with the buyer and the company will not be responsible if they are lost, stolen, damaged or destroyed.

23 The company has absolute right to use any photographs and illustrations of lots.

24 If a buyer claims that a lot is a deliberate forgery noticed must be served upon the company within 4 months of the sale date. The buyer must provide evidence of the alleged forgery that is acceptable to the Company. Upon accepting the validity of the evidence the Company will arrange with the buyer for return of the goods, the goods must be in the same condition as they were at the time of sale. Once the goods have been delivered back to the Company or its agents the sale will be rescinded. The vendor will refund the net proceeds of the sale to the Company within 14 days of the goods being returned. The company will refund amounts paid for the lot to the buyer within 7 days of receiving settlement from the vendor.

24.1 Where goods have been sold via the Company and a dispute between buyer and vendor relating to those goods can not be resolved by agreement it shall be settled by an arbitrator appointed by the Royal Institution of Chartered Surveyors, both buyer and vendor will be bound by the decisions of the arbitrator. Any costs incurred by using this service will be met by the buyer and/or vendor in the proportions decided by the arbitrator.

25 Where the Company uses premises for the conduct of its business every person on that premises is deemed to be there at there own risk and will have no claim against the company for accident or loss however caused.

26. Britannia Piano Auctions Ltd offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale. In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Britannia Piano Auctions Ltd :

- authorise Britannia Piano Auctions Ltd , if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and

- confirm that you are authorised to provide these credit card details to Britannia Piano Auctions Ltd through www.the-saleroom.com and agree that Britannia Piano Auctions Ltd are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.

Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price
