Barbers are happy to organise the package and despatch of items purchased. Packing is carried out in house by an experienced team. They use The Wey Group International and The Royal Mail.

Terms & Conditions

CONDITIONS OF SALE

1.            Barbers Fine Art Auctioneers Ltd. act in all respects, only as agents for the Vendor of each lot.

2.            The highest bid acceptable to the Auctioneer shall be the Purchaser at the hammer price and any dispute shall be settled at the Auctioneer's absolute discretion.  He may immediately put up the lot again for sale.  He is under no obligation to enforce payment by any buyer nor to undertake legal proceedings to recover such payment.

3.            The Auctioneer has the right at his absolute discretion to refuse any bid and to advance any bidding as he may decide.

4.            Warranty of Title

                (a)          The Vendor warrants to Barbers Fine Art Auctioneers Ltd. and to the Purchaser that he is the true owner of the property or is properly authorised to sell the property by the True owner and is free from any third party claim.

                (b)          The Vendor will indemnify Barbers Fine Art Auctioneers Ltd., his servants, agents and the Purchaser against any loss suffered by breach of (a).

5.            (a)          The Vendor shall be entitled to place a reserve on any lot and the Auctioneer shall have the right to bid on behalf of the Vendor for any lot on which a reserve price has been placed.

                (b)          The Auctioneer may at his absolute discretion withdraw or divide any lot or combine any two or more lots.

6.            (a)          All statements in the catalogues, brochures and advertising are statements of opinion and are not, nor are they to be relied upon, as statements or representation of fact.  Intending Purchasers must satisfy themselves of all faults, imperfections and errors of description.  Illustrations in catalogues are for identification only.

                (b)          Neither the vendor, Barbers Fine Art Auctioneers Ltd., nor any person in their employ may, or have any authority to, make any representation of warranty, authorship, origin, date, age, attribution, genuineness, provenance, errors of description, faults or defects.

7.            Payment

The purchase price payable by the Purchaser shall be 18% plus VAT.

8.            Settlement should be made within TWO weeks of sale.  After two weeks Barbers reserve the right to charge storage of £5.00 per item, per week, or part thereof, subject to V.A.T. As agents, Barbers are not responsible for any default by the Purchaser but will do all in their power to assist the Vendor in recovering the appropriate price, if necessary re-entering the items in a later auction.

9.            Every person shall be deemed to be on the premises at his or her own risk before, during and after the sale and with notice of the condition of the premises and the arrangement of furniture and no person shall have or make any claim in respect of any injury he may sustain, or any accident which may happen against the Vendor or the Auctioneer.

10.          The cost of making good any damage to the premises on which the sale takes place or to any lot or to part or parts caused by removal or otherwise by persons on the premises shall be paid for by the said persons, principals being considered responsible for the acts of their servants.  The assessment of such damage to be made by the Auctioneer whose decision shall be final and binding.

11.          Commission Bids:  Intending Purchasers who are unable to attend the sale may leave bids with the Auctioneers who undertake to purchase lots as cheaply as allowed by other bids and any reserves.  Bids must normally be submitted in writing and the Auctioneers, whilst taking every care, cannot be held responsible for any errors or omissions.  They must state the sender's full name and address and telephone number.  All commission bids should be received at least half an hour before the Sale commences.

12.          There is a 1% insurance charge and a lotting charge of £3.00 per lot, subject to VAT.
