TERMS OF SALE BY AUCTION AND CONDITIONS OF BUSINESS

CONCERNING BIDDERS AND BUYERS

 

All Purchases are 20 % plus VAT
Vat is only charged on our 20% fee not on the total amount

All Internet bids will incur an extra charge of 3% on successful purchases.

All electrical goods are sold as “ornaments” only and if bought for use must be checked for compliance with safety regulations by a qualified electrician. Any upholstered furniture or materials without fire certificates are sold as
All members of the public on our premises are there at their own risk. Auction House Berwick disclaims any liability in respect of any injury or accident, which may occur.

 

Auction House Berwick will act only as agents and Auctioneers for the vendors.
The vendor guarantees to Auction House Berwick that they have absolute legal title to the goods or authority from the owner to sell, that they are over 18 and that details given as to their identification are true and accurate.
All goods will be sold without reserve unless otherwise instructed by the vendor and agreed by the auctioneers.

All lots are offered for sale as found, with any defects, faults and omissions.
All buyers are deemed to have satisfied themselves as to age, condition and authenticity etc., before bidding.
Commission bids may be left with the auctioneers indicating the sums to be bid for any lot excluding buyer’s commission. The auctioneer will execute the bid as cheaply as possible having regard to the reserve of the item/items (if any) and any other competing bids. If two buyers submit identical Commission bids the auctioneer may or may not prefer the first bid received. Please enquire in advance before the start of the sale about arrangements for leaving commission bids by telephone, Email or in person.
Commission bids will be at the buyers risk and without legal obligation and must be in writing.
Telephone bids are to be accepted by prior arrangement with the Auctioneers.
Goods will be sold to the highest bidder and the Auctioneer will have absolute discretion to regulate bidding, to re-offer lots where necessary and resolve any differences.

The Auctioneers have absolute discretion to divide any lot, to combine any two or more lots or to withdraw any lot or lots from the sale, to refuse bids, regulate bidding, or cancel the sale without in any case giving a reason or without previous notice. He may bid on behalf of the Vendor for all goods which are being offered subject to the reserve or at the Auctioneer's discretion. The vendor gives Auction House Berwick absolute right to photograph and illustrate any item placed for sale and to utilise the results as deemed necessary.
Any conditions, notices, descriptions, statements and other matters in the catalogue and elsewhere concerning any lot are subject to any statements modifying or affecting the same made by the Auctioneer prior to any bid being accepted for the lot.
Each and every lot as set out in the catalogue or as divided or combined with any other lot or lots is sold by the Vendor with all faults, imperfections and errors of description. All items offered for auction are available for viewing and are not subject to The Sale of Goods Act 1979.

The Auctioneers do not accept responsibility for any authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot, unless they have been specifically instructed to do so by the Vendor in writing so to certify, and in such cases the Auctioneers do so as Agents of the Vendor and are not themselves responsible for such claims.
All purchasers by making a bid for a lot acknowledges that they have satisfied themselves fully before bidding by inspection or otherwise as to all of the Sale Conditions, the physical condition of and description of the lot including, but not restricted to whether the lot is damaged or has been repaired or restored.
Each lot is at the sole risk of the Purchaser from the fall of the hammer. However, legal title shall not pass to the Purchaser until the lot(s) have been paid for, the price being the hammer price plus any Buyer's Premium.
Each Purchaser shall forthwith give upon request their full names and permanent address and if called upon to do so by the Auctioneer shall forthwith pay Auction House Berwick such proportion of the purchase price as the Auctioneer may require. If the Purchaser fails to do so, the lot may at the Auctioneer's discretion be put up again and re-sold.
No lot or lots to be removed until the whole of the Purchaser’s account is paid in full. All purchases shall be paid for and removed at the Buyer's risk and expense.
In the event of any failure of the Purchaser to comply with any of the above conditions, the damages recoverable by the Auctioneers from the defaulter shall include any loss arising on any resale of the lot, together with charges and expenses in respect of both sales, and together with interest at 2% above the Base Rate upon the price of any lot which has not been paid for within 72 hours of sale, and any money deposited in part payment shall be held by the Auctioneers on account of any liability of the defaulter to them.
Payment by cheque, cash or credit/debit card. Credit cards attract an additional 3% charge. Buyers unknown to us are advised to make arrangements before the sale for references if paying by cheque, as cheques must be cleared before purchases can be removed. A Buyer's Premium of 20% plus VAT will be charged to the purchaser on the hammer price.

If payment is not received within 72 hours we reserve the right to take payment from any card registered with the Saleroom. It is then the responsibility of the owner to contact us and arrange collection or delivery. We reserve the right to sell or re-auction any item not collected to settle storage charges if the buyer has not contacted us the weekend prior to our next auction at our discretion with a reserve which would cover these costs.

 

Lots may be removed once payment has been cleared at the discretion of the Auctioneer and or porters during the sale and or immediately after the sale. All lots must be removed within 72 hours of purchase or will be put into store at the rate of £5.00 per day. Delivery is available please ask for details.
