Terms and Conditions
CONDITIONS OF SALE
1. The highest bidder to be the buyer; subject to the reservation that the Auctioneers shall have the rights (a) of regulating the bidding (b) of rejecting any bid (c) of determining in their absolute discretion all disputes regarding the biddings or any other matter arising under these Conditions; and also (d) of bidding for, withdrawing, consolidating, dividing or altering the order of lots.
2. All lots are put up for sale subject (a) to any reserved price imposed by the seller or (b) to the right of the seller to bid either personally or by any one person (who may be the Auctioneer).
3. The purchase money for each lot to be paid at the fall of the hammer, together with a commission of 15 per cent plus V.A.T., being the Auctioneers’ commission in accordance with the custom of the county. Each and every lot at the fall of the hammer shall be at the sole risk and expense of the respective purchaser, and shall be paid for and removed immediately after the conclusion of the sale, but no lot or lots shall become the property of the buyer, nor removeable until paid for, and if taken away in contravention of these conditions without an order for removal signed by the Auctioneers, they shall have power to seize the same by their servants or agents, or otherwise, or the Auctioneers may recover either the lots sold or the price thereof (at their option) by action at law.
3a. Online Bidding A.E. Dowse & Son offer an online bidding service via the-saleroom.com for bidders who cannot attend the sale. In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with A.E. Dowse & Son:
1. authorise A.E. Dowse & Son, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
2. confirm that you are authorised to provide these credit card details to A.E. Dowse & Son through www.the-saleroom.com and agree that A.E. Dowse & Son are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale. Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price
4. No person shall be allowed to retract their bidding. Immediately the lot is sold buyers shall when required give in their names and addresses and pay down a cash deposit of 25% or such other sum as the Auctioneers may demand as a security for the fulfi lment of the transaction. The Auctioneers will not recognise the transfer of any lot from one purchaser to another, nor make any alteration in the sale book in respect thereof, nor will they be responsible for any loss occasioned by fi re, accident or otherwise.
5. No contra account of any description whatever will be allowed to purchasers as a set off, and payment for the lot is to be made to the Auctioneers or their clerk only. Purchasers paying by cheque must give satisfactory references (if required), and no lot shall become the property of the buyer until the cheque has been cleared by the Bank.
6. For all purposes of this sale the Clerks of the Auctioneers shall be deemed to be the Agents of both Vendor and Purchaser.
7. The Purchaser shall be liable for all costs incurred in the collection or recovery of the purchase money through the non-compliance with these Conditions.
8. The Auctioneers act as Agents only. Each lot as set out in the Catalogues, or as divided or joined with any lot or lots at the sale at the sole discretion of the Auctioneers, is sold with all faults, imperfections and errors of description, and neither the vendor nor the Auctioneers are responsible for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot. All statements in the Catalogue as to any of such matters are statements of opinion, and are not to be taken as, or as implying, statements or representations of fact. Purchasers are deemed to have satisfi ed themselves by inspection or otherwise as to all such matters and as to the physical description of any lot. Neither the vendor nor the Auctioneers make or give, nor has any person in the employment of the Auctioneers any authority to make or give, any representation or warranty, and in any event neither the vendor nor the Auctioneers are responsible for any representation or warranty or for any statement in the Catalogue.
9. If any purchaser neglects or refuses to comply with the above Conditions, or any of them, his deposit money (if any) shall be forfeited, and the lots uncleared may, at the option of the Auctioneers, be re-sold, without notice, by public auction or private contract, and any loss occasioned by such re-sale, together with all expenses attendant thereon, or arising under these Conditions, shall be paid for by the defaulter at this sale, and be recoverable as and for liquidated damages. This condition is, however, without prejudice to the right of the Auctioneers to enforce the contract made at this sale if they think fi t. Value Added Tax at the rate in force at the time of sale is added to all commission and service charges.
